What I want you to do is take your right foot and put in front of your left just like this. >> All right. You can do that now. >> Yep. >> All right. So, when I say left, I want you to use the very tip of your left index finger. All right. Don't use the pad. Just the very tip of your finger. You're going to bring it straight up to the tip of your nose. You're going to bring it straight back down. All right. When I say right, same thing. Just using the very tip of your finger, not the pad. Just the very tip of your finger. You're going to bring it straight up. Touch the tip of your nose. You're going to bring it straight back down. >> Okay. >> Do you understand? >> Yeah. Seems too simple, but yes. >> All right. All right. You can close your eyes now. >> Okay. >> Left, right, left. right, right, left. All right, you can open your eyes for me. All right, you can turn around for me. Place under rest for dryicated serious. Why? I did everything. >> Oh, we're going to come straight back over here. Okay. >> I did. We're going to step right back over here. Okay. Okay. >> I'm not I'm not comfortable with this. What? What did I fail? Please tell me. >> You failed the test. It's all going to be >> No, no. I don't feel comfortable with being told I failed the test. >> We're going to come right up over here. >> No, no. Somebody has to tell me. Please. >> What part did I >> All right. Ma'am, please come over here. >> I will I will come. I'm not I'm not trying to like fight it. I'm just like I'm so >> All right. You can have a seat right in the car. Okay. >> Do you have anything in your pockets or no? I don't see. >> I don't think I might have. >> Yeah. >> Okay. Are you going to have a seat? >> Okay. >> My Okay. This is the problem. My >> husband has my daughter at home who's sleeping. She's literally one years old. >> Okay. You're You're not going to jail tonight. Okay, >> I know, but like what the heck is >> Just sit back for me so I can [ __ ] you up. All right. >> I don't understand why I would be. >> Sorry. I'm not trying to be like >> All right. Just give me just a couple minutes. What else did you need? You want your phone? >> Yeah, I definitely need my phone. I mean, my whole wallet, I guess. >> Is your wallet on the seat or where's your wallet? >> Um, I don't really see it. It's either on the seat or Yeah. Or like in the middle or something. Okay. All right. You can step on out. You can slide the shoes on. I'm going to take the handcuffs off once we get inside. That'll >> probably be okay. They're a little hand actually to be honest. I need like a >> Okay, if you want to just wait. I'll I'll bring them in and once I get you inside, I'll I'll take the cuffs off you. >> Okay. >> All right. You can go right up towards that officer. >> I'm going to come right up over here. Right there. This room right to your left. Right here. All right, you can uh put your shoes back on and you can have a seat on the bench for me. >> Can you go in my drawer and just grab my table? Can you just open your mouth for me, please? Lift your tongue up. Okay. >> All right. So, um, at the end of this, uh, I'll try to get you out of here as quickly as possible. You said your husband's home with your daughter. >> Yes. >> So, he's not going to be able to come pick you up? >> No. >> All right. Would he So, someone has a sign for you. All right. If we were to drive you home, you know, you live right in Memphis for Lake. If we were to drive you home, would your husband be able to sign for you there? That way he doesn't have to drag you. Okay. So, that would be the best case for you. >> Yes. >> Okay. >> All right. The next question is going to re your Miranda rights. Okay. >> You have the right to remain silent. Do you understand that? >> Just a verbal yes, please. >> Anything you say can will be used against you in the court of law. Do you understand that? >> You have the right to talk to a lawyer and have him present with you while you're being questioned. Do you understand that? >> Yes. If you cannot afford to hire a lawyer, one will be appointed at no cost to represent you before any questioning if you wish one. Do you understand that? >> Yes. >> If you agree to talk to us, a decision to wave these rights is not final. You may withdraw your waiver whenever you wish, either before or during question. Do you understand that? >> Yes. >> All right. Couple questions for you. I didn't come up with questions. Any of the questions you don't want to answer, you can either just stay silent or just tell me you don't want to answer it. I don't take it personally. >> Um, what kind of alcohol drinks did you have? today. >> Yes. >> I um it's called Surfside. >> How many? >> Um I'm just thinking what time. I'm not trying to I'm just trying to think cuz I haven't like necessarily thought this through. I had probably when I got there would have been 5:00. So I would have had one when I first got there and then another one pretty immediately after. And 3 after that. So at least 5 >> and >> starting at 5:00 p.m. >> And you said you had him at your friend's house, >> huh? >> You said you had him at a friend's house. >> No, I was at the Phillies game. >> Oh, you were at the Phillies game? >> Yeah. >> Okay. >> So, you had it at the stadium? >> Yeah. I waited at the end till it edited and then worked. >> Um, and what was the time in between each drink? Would you say >> it was not >> various? >> Yeah, it was not like completely consistent between each drink. So, I'm not I mean, I was just not really like paying attention. >> And, uh, you answered another question I'd have to ask you. Um, which is when you had your first drink. I marked down 5:00 p.m. cuz you said that's about right. >> 5 p.m. >> Um, and when what time did you have your last drink? Um, I guess whenever the fill is being meed like it is not dark outside, so I would guess like 9 between 8 and 9. >> All right. And I just got to read you this uh this form, so just bear with me. Okay. >> What's happening right now? >> Okay. So, um, what's happening right now is right now you're obviously under arrest for the DWI. All right. >> Under arrest. >> Yeah. you're in. Yeah, you're in custody for uh the DWI. Um so the next step is I have to read you this form um which is basically whether you're going to agree to provide breath samples for the breathalyzer. >> Okay. >> Okay. >> Yeah. Yeah. Yeah. So we have to go through a process. I got to wait 20 minutes then I can bring you in there and all that stuff and then we can go from there. Once that goes in, you'll get a copy of all the paperwork um with a court date and all that. You'll get what your breath test reading may or may not be. Um and then it'll, you know, everything will be broken down for you. Okay. >> Um, you have been arrested for drive while intoxicated NJSA 394-50. The law requires you to submit samples of your breath for the purpose of testing and determine alcohol content. A record of the taking of breath samples, including the test results will be made. Upon your request, a copy of the record will be made available to you. After you provide samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or urine for independent testing. If you refuse to provide samples of your breath, you'll be issued a separate summon for refusal. Court may find you guilty of both refusal and drive while intoxicated. If a court finds you guilty of refusal, you'll be subject to various penalties, including license revoke of up to 20 years, a fine of up to $2,000, installation of ignition interlock, and a referral to Intoxicated Driver Resource Center. These penalties may be in addition to penalties imposed by the court for any other offense for which you are found guilty. You have no legal right to have an attorney, physician, or anyone else present for the purpose of taking the breath samples. You have no legal right to refuse to give delay giving samples of your breath. Any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples, it will be treated as a refusal to submit to breath testing. Even if you agree to take the test, but then do not follow my instructions, do not properly perform the test, do not provide sufficient breath samples, I will charge you with refusal to submit to breath testing. I repeat, the law requires you to submit samples of your breath for testing. Will you submit samples of your breath? >> Yes. >> So, yeah. So, the process here, you're going to get issued a couple motor vehicle tickets. All right. In the state of New Jersey where we're one of two, this isn't a criminal offense. All right. So, it doesn't go on your criminal record or anything like that. They're motor vehicle violations. All right. Other states like Pennsylvania where you came from, they're crimes. So, you'd be charged. It would be on your criminal record, stuff like that. So, New Jersey, not downplaying a DWI or why we're here. And again, we're not in the breath visor yet, but um you're going to get a couple traffic tickets with a court date, and then that's where you go moving forward. >> Okay. We're just going to come into the other room for the breath. Okay. >> All right. When you take a deep breath, blow them out. Just one more continuous breath. Continue going until you stop. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. All right. Let me go back in here. Yep. >> Like I said, you're just getting traffic tickets. Okay. So, it seems like a lot. It's standard DWI's. Okay. Um, so there's four tickets here. All right. DWI. Okay. Reckless driving, which we always write with the DWI. Um, fail to maintain your lane, which is the reason why I pulled you over, and the open containers of alcohol you had in your uh behind your driver's seat. >> Oh. I'm going to take the tickets with uh your copy here. You're going to get another copy just like this at Meford Lakes when we're done there. I'm going to put this right in your tote bag here. Okay. >> All right, man. Come back and follow me. your seat back in there. Please put your seat belt on there. >> Got my phone. >> Everything's in the bag. Yep. >> Yes. If you need directions, I got it. >> S94 be transporting one female not in custody starting 1 19948. 0 to 11 hours. >> Can I get out? >> Yeah, I got to let you out. Central 25. >> Yes. All right. This is uh going to be a copy of the form, ask you to sign, and then you can just sign here. Basically, what the board's saying is you're just going to make sure she doesn't have access to drive another car until she's okay. >> Right here. >> Yep. >> Thank you. Thank you. taking a trip.
