Turn around. Face away from me right now. >> Are you [ __ ] sure? On May 7th, 2025, at approximately 10:58 p.m. in Vancouver, Washington, near Northeast 14th Court and Northeast Minaha Street, Clark County Sheriff's deputies responded to a crash involving a vehicle that slammed into two parked cars. When deputies approached the driver, 54year-old Mark Fogle of Clakamus, Oregon, he immediately said, "My life is over." He was clearly intoxicated and was soon arrested for DUI. But what no one expected was what happened next. 23-year-old Deputy Bryson Leighton would soon find himself fighting for his life, not on the street, but inside the sheriff's office. This is the shocking body cam footage of that night. Viewer discretion is strongly advised. Clark County Sheriff's deputies arrive at the scene and make contact with 54y old Mark Fogle, who immediately says, "My life is over." >> Clearly intoxicated and holding a commercial driver's license. It's apparent he's referring to the devastating reality that a DUI arrest will likely cost him his livelihood. >> Cars. >> Okay. You need medical attention, sir? >> No, I do not. But my life is [ __ ] over. >> I wouldn't go that far. I do. >> Okay. >> You do not need medical attention, correct? >> I do not. But as you will see, I am a CDL driver. >> Okay. >> And like I said, my life's [ __ ] over. >> How much have you had to drink tonight? >> Uh, more than I need to. >> Okay. Where where are you coming? Are you on your way home? Is that what happened? >> No. >> Okay. >> Somebody else is involved. >> Yes. Yeah. >> All right. So, where were you drinking at? >> 5173 Queen. >> All right. Sir, I need you to step out of the here. >> I'm calling lawyer. >> Okay. Just say lawyer. >> Lastly, Frank Ocean, George Lincoln Edward, 1st of March, Mary Adam Robert, >> 1970 912. >> No lawyer. >> All right. So, hold this at my point, sir. >> Yeah. You're under arrest. >> Yes. Thank you. >> Don't put your hand in your pocket. >> My wallet. >> No. Drop it. >> He might need a little bit. Mark Fogle refused to perform a field sobriety test and was placed under arrest for suspected DUI. Deputy Bryson Leighton then transported him to the Washington State Patrol scale house in Ridgefield, Washington, a facility equipped with a dedicated breath test room used to collect evidentiary breath samples during DUI investigations. They arrived at the scale house at approximately 11:33 p.m. At 11:58 p.m., while inside the breath test room, Deputy Leighton radio dispatched to report that he was engaged in a physical altercation with the suspect. During the struggle, Fogle allegedly attempted to grab the deputy's firearm. In response, Deputy Leighton stabbed Fogle multiple times to stop the attack. >> We're going to go into the scale house here. We're sit down. We're going to take a test. Okay. If you're cooperative with me and you're cool with me, I'll take you out of handcuffs. If not, you're going to stay in handcuffs the whole time. You understand? All right. Go ahead and take a step out. >> Hey, everybody, Ben. Yes. >> Got it. >> Yeah. >> As Deputy Leighton prepares to remove Mark Fogle's handcuffs, the first red flags begin to surface. bench there. >> Once uncuffed, Fogle keeps his hands on his head for an unusually long time, claiming it's for the deputy's safety. He repeatedly says, "I'm not going to make it through the night." Was this the first sign that Fogle was already planning a self aside by cop scenario? >> You're okay for trans? No, I'm not. I'm not okay. What's this? It's >> for your safety. Well, >> you you promise you're not going to hurt me? >> I'm promising. >> Oh, my hands on my head. >> All right. Well, as long as you say you're not going to hurt me, like we're we're good here. If if you're worried, you think you're going to hurt me, I'm just going to put you back in handcuffs. >> All right. You're not going to hurt me. You're good. >> We're good. >> Okay. You can keep your hands down. You're all right. Or not. If you want to be uncomfortable, that's that's fine. >> You don't know who I'm dealing with. You don't know who you're dealing with. >> That's true. So, are you going to hurt me? >> No, I'm not. >> Okay. Well, I trust you. >> All right. You said you wanted to talk to a lawyer. Do you have one in mind or >> do I not? >> No. Like do you have a a specific >> I have a lawyer. I'm just saying lawyer. >> Okay. >> Maybe I'll make it through the night. I don't know. >> It is 2340. Mark, you're going to make it through the night. All right. This isn't as big a deal as you think it is. It's a mystery. It it No, you have no idea. >> Okay, go and open your mouth. I'm going to check in your mouth. Is there anything inside you that's not put there by a doctor or dentist? >> No. >> Okay. My life's [ __ ] over. >> Why do you say that? >> You keep saying, "Look at my CDL driver." >> Okay. So basically my life's [ __ ] over. Can't make a living. >> Doesn't immediately mean that your life is over, Mark. >> It is. >> I have done >> I have arrested CDL drivers before who have been able to turn around and make it through. >> I'm [ __ ] done. >> Do you want to call another lawyer? Yes or no? >> How many lawyers do I have that option? There's >> 14 on this list. All right. Well, all right. Well, yes. All right. Well, no. Sure. Sure. Okay. >> Honestly, what what's the matter? Like I said, I'm [ __ ] done. >> All right. We're just going to >> I'm a dead man. You're talking dead man. >> You're not a dead man, Mark. >> Yes, I am a dead man. >> Well, I'm not interested tonight. What [ __ ] time is it? >> It's midnight. >> Thank you. So, are are you going to kill yourself, Mark? >> Fogle continues making deeply concerning remarks. Each one a glaring red flag. At one point, he says, "You know what's crazy? It's just you and me in this [ __ ] room." A statement like that should have prompted Deputy Leighton to immediately call for backup and resecure Fogle in handcuffs. >> You know what's crazy? Is it It's just you and me in this [ __ ] room. >> It's just you and me in this room, but this is a police station. There's plenty of troopers here. >> Are there? >> Yeah. >> Are you sure? >> Did you not see me talking to the trooper when we first pulled up? >> People are here in the room. >> Are you Are you trying to make threatening? >> [ __ ] No. >> No. >> No. >> Okay. Why? Why are you saying things like that? >> I don't know. >> Okay, go ahead and stand up. Turn around. Face away from me. >> Sure. >> Are you sure? >> Yeah. Turn around. Face away from me right now. >> Are you [ __ ] sure? >> 73. I'm fighting with one. >> Are you [ __ ] sure? >> Give me the air. He's reaching for my gun. >> Mark, you're going to get [ __ ] shot. >> Yeah. Yeah. >> That's what I want. [ __ ] shot. Mark, get the [ __ ] away from me. Get the [ __ ] away from me. Mark, >> I'm not going to shoot you. >> During the violent struggle, Deputy Leighton's bodywn camera was deactivated. The suspect, Mark Fogle, initially gained the upper hand, forcing the deputy to the ground and attempting to take control of his firearm. Despite being overpowered at first, Deputy Leighton managed to regain control of the situation by stabbing Fogle multiple times to stop the assault and protect his weapon. By the time additional deputies arrived, Fogle was on the ground bleeding. He was quickly restrained and placed in handcuffs, and deputies on scene immediately began rendering first aid. This is just another example of the dangers police officers face on a daily basis, >> and it shows you how fast a calm situation can turn deadly. Did that get out over there? >> I don't know. Oh, I didn't hear it. Boy 73, did you copy my traffic? probably. >> Yeah. >> I'm not going to let you die, Mark. >> I'm not going to let you die, Mark. You're going to be okay, man. No. >> Deputy Leighton with support from assisting agencies immediately began providing first aid to Mark Fogle. >> Shortly after a Clark Cowlett's fire rescue ambulance arrived on scene. >> Despite their efforts, Fogle's injuries were too severe to stabilize or allow for transport. At 12:39 a.m. on May 8th, 2025, medics pronounced him deceased at the scene. Investigators believe Mark Fogle may have been attempting a self- aside by cops scenario, driven by the belief that his life was over due to the DUI arrest and the devastating impact it would have had on his commercial driver's license.
