On November 15th, 2024, an officer with Washington Department of Fish and Wildlife was on patrol when he observed two individuals harvesting razor clams. At the time of this interaction, razor clams had a 15 per person bag limit. You got a couple there. Yeah, we Okay, there's one limit. Okay. This is the all our catch. Okay. Yeah. Okay. You guys are both being charged with over limit cuz you had 140 razor clams. You're only allowed to have 30. So you're How many more? How many? You're 110 over just each one? You knew he dug more than 15 clams and you knew you didn't. I don't know. Okay. Well, that's something you have to explain to the judge or get an attorney. I don't know. Have a limit. Have the attorney necessary to have attorney. Uh that's why you're going to court. They'll offer you that option at the time when you go to court. It's not that's not your trial. That's just your initial hearing. Okay. Before the judge and she'll review your rights and offer you that option. Okay. Any questions on whether or not? No. Mainly the only thing you need to know is that you need to show up in court. If you don't show up in court, there'll be a warrant out for your Okay. If we hire a lawyer or have to first time have to go or after after first, right? After the first time. After first time. Okay. Yeah. You can bring you can bring a lawyer anytime you want. If you want to bring a lawyer to the first one, you can. Uh but you don't have to. Okay? They're just going to read your rights and and offer you the option of having an attorney and whether or not you want to plead right there or you whether or not you want to go forward with the trial or whatever. So that's your that's your initial hearing. What kind of sentence are are we facing facing? Do you know? Um that's up to the judge pro in my opinion. I think it' probably just be some kind of fine. Okay. Um how much people don't go typically go to jail for this kind of stuff. It's just more of a fine based on the uh the we used to issue a fine but we can't do that anymore. Do you know the the the what is the kind of like upper lower limit of it'll be up to the up to the judge. We don't previous one we don't we haven't issued fines in a long time like over 10 years. It's been up to the court. Okay. Yeah. Okay. But is this considered as a criminal if uh if those are both criminal charges? Yes. So, you want to you want to you want to consult with your attorney or ask the judge what the what they'll explain to you what the parameters are when you get to court. I can't explain to those. In the end, both were charged with being over the bag limit on razor clams and failing to provide clams for inspection upon request. The court records were not available online, but we called the courthouse to discuss. On two different phone calls, we were advised that both cases were closed and dismissed. In complete disbelief, we called the prosecutor's office. We were advised that both suspects entered a six-month pre-trial diversion program.
