Hi, I'm officer with Pullman Police. I'm pulling you over because you're driving around without headlights on. >> Is there a reason for that? >> Yeah, I was just driving around with them. I'm like my friend's car. >> Okay. >> So, I'm like, am I like >> Yeah, they're not. like they might be down >> even if they are on. >> So, where are we going tonight? >> Walmart. >> Okay. >> To buy the girls some hair coloring. >> Some hair coloring. >> Yeah. >> Okay. How much have you had to drink tonight? >> I drink. >> You haven't had anything to drink? >> Breathalyze. >> You want me to breathalyze you? trade. Okay. Can I get your license, registration, insurance, please? So, when you operate a motor vehicle, few requirements you have, right? You need to make sure that it's registered, it has insurance, and you need to make sure you know the functions of the vehicle. Example would be how to turn the lights on, how to use the blinkers, that kind of thing. Okay? I'm going to give you a few minutes to find the insurance and the registration for me while I go document the stop. Okay? Stay in the car and I'll be back with you in a few minutes. >> Thanks. So, I get up there and she has a barely lit cigarette she just lit. I don't have any other indicators of impairment, but my flags are raised. The car is packed full. She says she's going to >> alert expired driver's license. >> Get the girl's hair dye at Walmart >> since she doesn't drink. I'm not sure I buy. Have you hang out? I'm gonna ask her to get out. See if she'll let me test her eyes and talk to her about the license. >> So, >> I can look at the registration. I can't see if you have insurance or not unless you can prove it to me. I have just look that up. This is a ledge schwab thing. So, make sure >> No, you can go ahead and hang that up. What I'm going to ask you to do is just step out and talk to me for a minute. Okay. I'll just have you come back here so we're not in the roadway or anything like that. So, Heather, a couple things. You know, you don't have a license, right? >> Yes. >> You're aware of that. So, how come you're driving? >> Because we're at my friend's house and her kids really wanted to go to Walmart and get their hair dyed and I'm like, I can just take them. >> How old is everybody inside the vehicle right now? Um, >> like what's the oldest person inside you in the vehicle right now? >> My son's 20. >> Does he have a license? >> Oh, >> he doesn't. Does anybody else have a license inside the vehicle? Okay. We can't be driving without a license, right? >> Yeah. So, >> I told her to come. >> You know, you're eligible for a license. You can get a license. Your Washington one expired. >> I know. Um, I mean, it's hard for me to get down here, but I just met her and she has a vehicle and she's willing to help me. So, I'm going to be doing that. It's so hard being star potlatch where there's no license, no car, and not that many friends, you know. >> Sure. But you're driving around down here now. >> I know. I just met her a few days ago. So, >> Okay. So, my other concern is that you've consumed liquor. Okay. So, let's talk about I hear what you're saying, right? But do you think it's the first time somebody's told me they didn't drink or they didn't drink and they have? Maybe. Maybe. So, right. >> Breath. >> So, that's not where we're at right now. Okay. Are you willing to let me >> check your eyes voluntarily? >> Yeah. >> Is that okay? All right. So, what I'm going to ask you to do is just stand >> back. Have a breathalyzer. >> That's not how this works. So, we don't just give people breathalyzers. >> Okay. Because I don't drink or draw my blood or something. What's that? >> You've been drawn by blood. >> I'm not a phabotamist. >> Okay. >> So, stand where you are now. Okay. I'm asking only I'm going to find shine my flashlight right here. I'm not trying to shine in your eyes, but I need to need to be able to see your eyes and observe them. Okay. When I hold my finger out here like this, you look at my finger. Can you see it perfectly and clearly? >> Yeah. >> Okay. Once again, hold my finger with your eyes. Hold your eyes. Do not move your head. Okay. If you have to blink, swing naturally. Last one is up. Leave your head where it is. Just follow with your eyes. So, I'm seeing some things that are telling me you've had something to drink tonight. Okay. >> So, what I'm going to ask you to do is perform some other voluntary field sobriety tests. Are you willing to do that? I'm going to um I'm on SSDI. >> Okay. Is there any other prescription medications that you're on? >> I'm on prescription. >> Well, I know SSDI. What do you take for >> I take pain medication? Um anxiety medication. >> Do any of those things say don't consume and then operate a motor vehicle on them? >> No. >> Pain medication doesn't say don't operate a motor vehicle while on this. No. >> Okay. So, what is the pain medication specifically? That's why um my mouth is dry and it may seem like I'm drinking, but I'm not. >> Okay. How about consumption of marijuana? >> What? >> No. >> None of that? >> No. >> Okay. Well, something's not adding up. So, either you're not telling me the truth and you've consumed something or I don't know. We can go from there. Are you willing to perform the rest of my voluntary? >> This is my back. I don't >> you never mentioned that until just now. >> I'm going to I can show you I have a 20in scar down my back. That's why I'm >> It's not that I don't believe you, but you just now mentioned this and you told me you mentioned it prior, which isn't the case. >> Um, >> is there is there anything else that would prevent you from walking for a short amount of time in a straight line or standing on one foot for a short time? So, let's try and get down here. It's a little more level. So, I'll have you stand right where my flashlight is. Face me. Okay. Okay. >> So, what I'm going to do is I'm going to talk you through it. I'm going to explain what the test is, okay? And then I'm going to demonstrate it for you so you know what it looks like and then I'm going to ask you perform it. Prior to that, I'm going to get you in a starting position. What I ask is that you stay in that starting position. If you happen to step out of it, just step back into it. I know you may be uncomfortable with some of your back issues. Does that make sense to you? So, imagine a straight line going out in front of you, right down this sidewalk. You put your right foot on that imaginary line. Go ahead and do that. I know. So, imagine a straight line out in front of you. Put your right foot on the line. >> Oh, and >> put your right foot on that. Put your left foot in front of your right foot with your heel touching your toe. The best thing to do is probably to keep your arms down at your sides for balance. >> You've been holding on to this quite a bit. Probably because your mouth is dry. >> Yeah. >> So, >> no, I'm not asking you to start yet. So, what I want you to do is I'm going to get you in a starting position. >> Son's jacket. I'm sorry, I'm freezing. >> Uh, the other officer can. Where is it located in the vehicle? >> Off the front seat. >> Okay. Can you get that for her? It's a jacket. >> Jacket. My friend jacket. Sorry. >> It's okay. I understand. I just want to make sure that you're safe to be on the road. I mean, you don't have a license, but the main thing is the safety of other motor vehicles. >> Yeah. I wouldn't drive if I was. And I know you've heard it all, but if we went to the station, they drew blood and gives our I haven't drank. Part of what we do isn't >> What's that? >> I haven't drank in like since my son was born. He made me hate alcohol and I used to drink back in my 20s. >> So part of what we do is not just detecting alcohol, but it's also drugs. Okay. So other things can hurt you besides alcohol. And even if it's prescription medications, okay, to my knowledge, I've never seen any kind of pain medication that does not say do not drive a motor vehicle or operate heavy machinery on it. That's always been on a label when I've seen them. So, >> pharmacy on their um >> well, generally they give you a sheet and that sheet's going to have what your potential side effects are from the medication as well as the dos and don'ts on it. Like one is you want to eat with pain medication. Two is you don't want to operate heavy machinery to drive. Okay. So, just tell you again. I'm going to get you in a starting position. I'm going to ask you stay in that position. If you step out of it, try to step back into it for me. I'm going to then explain the test to you. I'm going to give you a demonstration. Then I'm going to ask you perform it. So, just like we said before, imagine a straight line right in the center of the sidewalk out in front of you. Put your right foot on that line for me. >> Yes. And then put your left foot in front of your right foot, heel touching toe, and then stay in that position. Can you put your arms down at your sides while you're doing that? So, just don't don't start. I'm just getting you in a starting position. I want you to stay there. So, you're going to put your right foot on a line. You're going to put your left foot in front of your right foot, heel touching toe, and arms down to your sides. And I want you to stay in that position. Okay? If you step out of it, step back into it for me. Okay? when I ask you to begin and not until then, you're going to take nine heel totoe steps down the line. You're going to turn around the way I'm going to show you and then you're going to take nine heel totoe steps back down the line. Okay? While you're doing it, I want you to look down at your feet. I want you to count out loud. I want you to keep your arms down at your sides and I do not want you to stop until it's completed. Do you understand that? >> So, nine turn around. >> That's correct. For demonstration, I'm going to do three, but you're going to do nine. Okay? It's going to look like this. Just like you are now. My right foot is on that line. My left foot is in front of my right foot right foot. Heel touching toe. And my arms are down at my sides. When I tell you to begin, you're going to take nine heel totoe steps just like this. One, two, three, until you get to nine. When you get to nine, you're going to take a series of small steps with your trail foot around your lead foot like so. And then you're going to do nine heel totoe steps back down the line, completing the test. Do you understand the test? Okay, you may begin. Okay. The last test I'm going to ask you to do is called one leg stand. Okay. Once again, I'm going to get you in a starting position, which is very similar to how you're standing. Now, I'm going to explain it to you. I'm going to demonstrate it for you. Then, I'm going to ask you to do the test. Okay? So, this one, pretty simple starting position. Heels and toes together, arms down at your sides. You can stand like that. It's cold out. Okay? When I ask you to begin, you're going to choose a leg. It does not matter which one. For demonstration, I'm going to raise my right leg. When I raise my right leg, I'm going to keep my foot off the ground approximately 6 in with my toy my toe generally pointed out or my foot level with the ground, my arms down at my sides. And I'm going to count out like this. 100,00 1,002 1003 and so on until I tell you to stop. So, just like you are now, okay, I'm going to choose my right leg. You can choose either one, which is more comfortable for you. It's going to look like this. 1,00 1,002 1003 1004 1005 1006 and so on until I tell you to stop. Do you understand the test? >> Okay, you may begin. >> Keep going. Yeah. Yeah. This is the most level ground I see. I mean, I So, I know it's a little windy, but I was able to do it pretty easy. Okay, you can stop. Last thing I'm going to ask you to do, if you're willing to do it voluntarily, is give me a preliminary breath sample. That was the test your breath you were talking about earlier. Keep in mind, this does not take the place of any evidentiary test I may ask you to take in the future, and it is not admissible important. Are you willing to do a preliminary breath test? Of >> course. >> Okay. Just stand here for me. Okay. >> Yeah. >> So, when I ask you to give me breath, what I want you to do is take a deep breath in and blow into this like you're blowing up a balloon. Okay. Deep breath in. Keep going. Keep going. Keep going. It's good. Zeros. Okay. I think I was lying. >> Uh, it's not whether you whether I think you're lying or not does not matter. >> It's not I I follow where the evidence leads and this is where the evidence is led. Okay. >> I don't think you consumed alcohol. I do think you're on prescription medications and possibly marijuana. Okay. I think >> I hear what you're saying. Okay. I can give you a test for marijuana right now. Are you willing to do that? Okay. So, just face me. I'll let you keep your arms in your pockets because it's cold. So, can you take your hood off for me, please? Just momentarily. >> Well, wait. This is the third day, right? >> I'm not having you pee on a stick. What I'm going to do is an eye test. >> Oh, yeah. Can you take the hood off so I can see your eyes a little bit better? Okay. >> Sorry, my blinds a lot. >> So, what I'm going to ask you to do is follow my eyes or follow my finger with your eyes again. Okay. It's going to look like I'm going to touch your nose, but I am not. >> Does that make sense? Okay. So, follow my finger, please. One more time. Okay. So, I have indicators that you have smoked marijuana or some sort of cannabis. I also have indicators that you have been consuming something that I'm not aware of. So, at this time, you are under arrest for DUI. I can't hear you. What' you say? >> Yeah, we'll deal with all that in just a moment. Okay. >> We'll talk about all that in just a moment. I'm trying to not get these handcuffs on in a manner that's going to be super uncomfortable for you. Just stay in the car. We'll we'll be over there in a minute to talk to you. Just one second. Just so you know, you're being audio and video recorded. It is February 23rd, 2025 at 20 53 hours. Do you have anything in your pockets that's going to poke, stick me, stab me, anything like that? Okay. So, I'm going to ask you to step over here by this wheel. Separate your feet for me, please. >> Yeah. Just a moment once I get her in the back. I'll answer all your questions without searching you. I just want to focus on what I'm doing for the moment. Okay. Lock your hand. Okay. If you want to go talk to them, get working on that. I will answer all your questions. I'll get you in here where it's grab your property as well. So, what you want to do is Yeah. Sit back first. Watch your head and swing your leg. So, what questions do you have? >> Just about. >> Okay. So, we don't do a bail thing, but we can only hold you for a max of 6 hours in our holding facility, and you will be released before then. >> 6 hours. >> I not saying it's going to be the full 6 hours. I have paperwork to do, and we have some other things we have to get through, but we can only hold you for a max of six hours. >> That is what it is. That is my answer to your question. There's not a bail process. Do you have any other questions? Besides your purse, is there anything else from inside of the vehicle that I can grab for you? >> Um, it's my son's getting home. Um, I just need my purses. I thought that I was going to need money, but I'll just leave that with my son. >> You want to leave the whole purse with him? Do you need a cell phone or anything else inside of it? Um um actually yeah I need my phone. >> Your phone? >> The phone. >> So just the phone is all you need. >> Yeah because it has numbers again. >> Okay. I will be back. >> Can you tell my son that I want to be? >> That's fine. Just my phone is firing. >> Okay. My cigas will probably get thrown away. So >> yeah. So we wouldn't throw them away necessarily, but they'd go in your property and you don't get to consume any nicotine products while you're in the holding facility. >> Yeah. >> So it wouldn't do you any good in there anyway. >> Okay. So that's probably >> Okay. And I'll let them know the kind of the process in the timeline, too. Okay. [Music] >> Okay. Go ahead and swing your legs out first. I'll grab it on your arm to help you. Okay. There we go. Once we get inside, like I said, we'll get the cuffs off. So, as we go through here, just stay to the right for me. There we go. All right. So, just walk on in. Face the wall for me right here. I'm going to release your left hand first. When I do, just place it nice and high on the wall like this for me. and watch that were making it uncomfortable. >> What's that? >> It was my bracelet and watch that. >> Yeah. And that's why when we were out there, I was trying really hard to get it to where I was on top of that stuff. >> Yeah. >> Where I wasn't making it uncomfortable, but the jewelry. Yeah. It was the watch. >> Yeah. >> So, Heather, just come this way for me. Have a seat in this brown chair. Okay. >> So, I can't do that yet. Once we're done with this uh this breath instrument here, I can give you a glass of water. So, this thing has to do some internal checks and stuff like that. It's sort of similar to the one we did out there, the preliminary breath test, but this one does take a little bit larger volume of breath. [Applause] So, these are completely packaged. They haven't been messed with. They're sealed in here. That way, you know, they're clean and sterile and stuff like that. So, I'm going to actually hold the tube for you whenever you do it. A lot of people like to try and grab on and have, you know, their hands on it, but um prefer you don't do that. Um you can stand if you want to, if you feel like that would help you, or you can remain seated. It's really up to you. I take inhales a bit. So I run out of breath. >> Okay. >> Really um quickly because I don't know >> I don't know what's going on. We'll do our best. But I >> I'm going out of breath really quickly like you can see. >> Okay. >> Um so we might have to do it a couple times. Okay. >> Because right when you told me to stop I was like get out of there. >> Gotcha. Okay. So, deep breath in like you're blowing up a balloon. Keep going. Keep going. You're almost there. Almost there. And stop. >> And then this one I'm just going to throw in the garbage. And we're going to use Oops. We're going to use this sealed one. Even though I accidentally threw the package away, it's completely sealed. Still clean. It's ter. And it has to go through those same kind of tests again for a moment and then we'll do the second one. So, it's not that bad, but I tell people that because people struggle with this one more than the other one for some reason. >> What do you mean struggle? >> Um, like they can't give enough volume or breath or they don't breathe into the tube. Like it's just weird. People do weird things, but obviously you did fine. So, >> thank you. >> So, just like before, I'm I can see the volume. I'm gonna ask that I'm gonna just make you give the pretty much the exact same thing you did before. Okay. >> Ready? Going. Keep going. You're almost there. Going. Keep going. Keep going. And good. Thank you. >> So, you take three breathalyzers. So preliminary breath test isn't the same as an evidentiary test like this, but what this one requires is two independent breath samples. So, and that's why for the preliminary breath test when I was out there, I said it doesn't take the place of any evidentiary test I may ask you to do. And it's not admissible in court either. These are a lot more accurate and they do all those checks. You see the other ones, we do checks on them every so often, but that's why they're not a missful because we'd have to do a check like uh all these different checks that they do. We'd have to do that in between every single >> calibrate that. >> Exactly. Yep. And make sure it's within threshold and it uses all this crazy science >> technology. >> Yeah. It's getting out of control. And whenever whenever I have to put you in the holding cell, um we'll get you a water cup and I'll get you a blanket and stuff, too, so you can stay warmer. Yeah, of course. Yeah. All the all the brick and stuff in here. I know it's a lot colder than it should. >> Is there um Can I have my water bottle? Can I take >> No, I couldn't bring that. I can't bring like liquids and stuff like that in here and give it to you. >> Oh, there's probably something in there, right? >> Yeah. Yeah, you have the ability to get water in there. So, as you can see here, your results are all zeros just like they were with the preliminary breath test out there. Okay. And you you will get a copy of this as well. Okay, that is all I need for now. Um, I'll bring you a blanket and stuff in just a moment. Okay. So, I'm gonna have you come in here into a I think this one's probably okay. Okay. So, just to give you a rundown of stuff. Okay. The water works. This is the flush. Flush. Hot. Hot. Cold. Toilet paper's in here. And really loud. What? What did you say? Oh, this is so cold. >> Yeah. I'm going to grab you a blanket right now. Okay. [Music] hacker. >> All right, just hang out for a little bit. When the DR gets here, like I said, I'll introduce you to him and we'll go from there. Okay, >> I'm going to get working on some paperwork so you don't sit here forever. Okay, >> Heather, you ready to go get out of here? All right. What's that? >> Not at all. Leave the blanket there for me. >> Did anyone call for me? >> Uh, nobody's called the PD. I'll let you have access to your phone. You can call somebody, though. Okay. They probably told him it was going to be a little while. Officer Romero probably did. So, I got to explain some paperwork to you. I got to get um some photographs and fingerprints, and then you're free to go. And you can hang out in the lobby and make all the calls you need. Okay. All right. So, first off, we'll do the forms at the end here. I'm going to take the blanket from you. We're just going to leave it in here. Yeah. It won't be long and we'll be moving around and stuff. So, all right. So, this blue sheet, can you stand in front of it for me, please? So, just look directly at me. And then without moving your body, just turn and look at that red dot. Okay. And then right over here, go over the uh the citation first. Okay. >> So, the two main issues we're dealing with. Okay. So, you're being charged with DUI RCW4661502. Your information is up top. The vehicle information is in here as well. I know it was your vehicle per se, but it's the one you were driving at the time. My name, my badge number is here. This is a criminal citation. You need to read it and become very familiar with it, please. >> It is a misdemeanor. You had two other DUIs, but they were I think one was 07, one was 09, and so they don't meet the requirements to be a felony in this state. So, it would have to be the third within a much shorter time period. And those have been 18 years, right? So, it's been a long time. I looked at my bill. >> This one is an infraction. So, it's a traffic ticket. It's for driving the motor vehicle without a proper driver's license. It's called no valid operator license, but you did have ID on you. So, that's better than not having ID on you. Okay. >> It's RCW462015. It's a $559 ticket. As far as Washington goes, that's about middle of the road. Washington is a very expensive state. Um, you have 33 days from today to deal with this. You can pay it. You can go on a payment plan. You can go to a mitigation hearing or you can contest it in court if you feel like you didn't do it and you want to fight the ticket and that is one of your rights. Um, I did not write you a ticket for no insurance. Okay, I'm going to cut you a break on that. I know it's been a rough night. Um, but you can't drive vehicles without insurance. I know you may not have been aware of that, but you still if you're operating a motor vehicle need to ensure it has those things I was talking to you at the window about. Okay, so these are different. This is the real important one. This one is also important, but you have some time. You have 33 days to deal with this one from today's date. >> So, I can just call the court, make payment arrangements. >> You can. So, it gives you all the info you need here. >> It's This one's 559 is what it >> My glasses looks like fuzz to me. >> Okay. Well, you can read it later. Your infraction number is listed here. >> If you have any questions, there's a phone number here you can call or a website you can go to. So, that's pretty helpful. Okay. This is the criminal one. This is arguably more important one. So, make sure you know this one. Now, as it relates to that, your initial appearance is tomorrow on this. >> What? >> Washington, it's next day. So, >> Oh, I forgot to write your name in there. >> Um, is it by phone, I hope. >> Uh, it is not by phone. >> It is in it is in person. It is in Kfax. So what essentially? Give me one second. >> Tomorrow 9:00 a.m. >> It's at 3:00 p.m. So it gives you a little bit of time. It's not in the morning. So it kind of alternates whether it's in Pullman or it's in KFax. Monday is the next business day, which is what we're required to assign you. So Monday at 3 p.m. in Kfax. This is the address right here. It's at North 400 Main Street in Kfax. Okay. So, you're required. Me releasing you tonight is with a promise to appear in court. Okay. People that go, "Well, I'm not going to make it." We have to book them into the county jail >> and then they're held until they see a judge. Right. So, this is basically you promising me. Yeah. Right. So, this is basically you telling me, "Hey, I promise I'm going to make it there." And what it says down here is >> your appearance is mandatory. If you don't show up, bench warrant will be issued for your arrest. Okay. in this box here in the big bold letters and that's why they're big and bold so people make sure they read that section of it. Okay. So, as I give you your promise to appear, can you sign there for me? I will do the date and time. I will be there. >> Yeah, warrants are no fun cuz then you're like looking over your shoulder and all that stuff. I'm glad this isn't a felony. I thought I heard you say a felony ticket. I'm like, "No, I've never had a felony." >> No, I was just explaining to him when he arrived. He asked if you had prior UIs. I just explained to him that none met the requirement for >> Typically, so right now you don't have a license. So, typically that's for somebody that has it and it's going to be suspended. But I don't know if it's going to change your eligibility, right? because you were eligible in Washington just expired in Idaho. Looks like yours expired in Idaho in 2019 from the looks of it. If my memory served, it looks like your license in Idaho expired in 2019. So, you didn't have a valid license in Idaho. And then >> I was allowed to get one. >> It doesn't show you are suspended or have any holds that I'm seeing when I ran your state return. And then in Washington, you're also eligible. So, I don't see any holds or suspensions either. Now, you can call and talk to DO and that's who that form is for. Um, but I did not see anything on there. So, I think you can go get a license whenever you want to get a license. This may this may shake things up and you'll have to verify that with them, but as of when I ran it tonight, I did not see any suspensions or holds on there. And so, we have a warm lobby. The Wi-Fi works there as well. You can take as long as you need in there to find your ride and figure things out. Okay. Don't feel like you got to rush out. At least you're not out in the rain. I think it stopped raining, but still, it's still cold and windy. So, in our policy, we're not allowed to give rides for a lot of things. We can offer to give resources like taxis and things like that. >> I need to kill these people. I cannot believe. Is it a far walk? >> What is your definition of far? because it's probably up to True Street. It's maybe mile and a half. Can't believe she's not answering. Hello, Jess. Can you come get me? Bring me a cigarette. All right. Thank you. You're at your house, right? Okay, cool. All right. How are you? How are you? Bye. Oh, >> I'm glad she answered. >> Don't forget your paperwork. Some of this stuff you're definitely going to need. >> Oh, I won't forget. >> So, when you push through this door, you're going to see another door. Push through that one. You'll be in the lobby. Okay. She should pull up right in the parking lot. You can see her through the big bay windows. Um, do you know her? Willis. Oh, you're Willis, not Wallace. >> Willis, not Wallace.
