place on the east side of crab Highland welcome to CRA Island you going see twerking a pontoon boat with several passengers was obser served with his engine revving up and out of the water and the vessel's motor was creating a large Splash due to the motor being in gear but not properly trimmed in the water which isn't illegal but it's a Sure Fire way to catch the attention of water Patrol it's the equivalent of doing a burnout or revving your car engine at Max RPM in park seeing that this behavior is generally associated with impaired operation or out of stupidity the officer chased the vessel down and conducted a safety inspection the current's a little strong that's fine just stay there just hang tight all right turn off no as long as you're neutral you're good I'm pretty sure I am did we do anything wrong or you just doing um doing a boting safety inspection okay all right so how long you guys been out today is this a rental yes okay how long have you guys been out all day okay all right who rented the boat I get uh well her uncle paid for it and we signed for it so okay so on the vessel who rented the boat who who's in charge of the boat the driver I would be The Driver well you're the driver when I pulled you over but uh he was also operating so who's in charge of the boat no he was helping with the trim to get out of the sand that's all he did all right so who is people moving around since the start of this body Camp footage is extremely windy and I value my viewers eardrums I've edited some of this interaction so here's what you want to know the occupants claim that this man has been operating The Vessel all day but when the officer spotted The Vessel with its motor revving outside of the water he observed this man at the helm and in the eyes of the law that means he's Captain as unfortunate as that is during the safety inspection the officer claimed to have noticed signs of impairment stating that he looked confused and often embracing himself to keep balance but let's be real guys these aren't exactly calm Waters in fact the water is so choppy the officer Towes the pontoon boat back to dry land I got the boats all right now now don't have to worry about the traffic and everything else all right so who's um who's in your party that that went on the boat with you guys all of us everybody well you said you were dropping him off over there yes sir okay did was he in the boat originally or no we picked him over there in the harbor okay know sop all right so any anybody else that's in the boat like I'm I'm a little confused when you said that everybody's on the boat but was originally in the boat but you picked him up in the harbor yeah and then two of the kids that are on the boat with us okay all right so captain no yes okay all fist against left fist I need you to remain in this position so I explain the rest of the task when I say begin you must perform four tasks first task is to count out allow from one to four while moving your fists in a step-like fashion making contact between your fists at each step it'll look like this one 2 3 4 second task is a memorized position position of your fist after you've counted the four clap your hands three times return the fist into the memorized position one two no no don't start yet third task is to move your fist in a step like fashion in reverse order counting allowed from five to eight returning your left fist to your chest five six 7 8 this is all at once mm do you understand task sir I'm going to ask you just let let me talk to him right now okay all right you __ ] like driver I'm the driver okay well at this point I can't I can't reverse this what's done is done if I reversed it then I'm I'd be held liable so uh I'm I'm sticking with my decision so right now what was that the test there's there's no breaks it's not a pass or fail I'm not I'm looking for specific things in these tasks I do and so just for like future Resturant what is considered operating you're whoever's behind the wheel in charge of the boats operating if you want if you want to know the definition operate you can uh you can type it up and you can Google it but um he is he behind the wheel he was okay so why is he because he was the operator oh here you go baby make sure that she wears this when you guys are in way okay $140 ticket if you don't right okay that makes him the driver yes so you're taking him to jail yes sir no I just want to understand in the end the man was transported to the Okaloosa County Jail where he was charged with boating under the influence and refusal to submit a breath test I'd also like to give you guys some advice if you're planning on having a few drinks while boating in Florida bring black trash bags to store your empties in and
