FWC Officers heard revving up out of water, and it was observed that the vessel's motor was creating a large splash due to not being properly trimmed in the water. The vessel was traveling southwest from Crab Island when the operator switched positions with one of the passengers. The observer approached the vessel and conducted a stop, identifying themselves to the operator and explaining that a vessel safety inspection was being conducted. The current operator stated they were leaving the Island. It was explained to both the current operator and the previous operator, [Redacted], that [Redacted] was observed operating the vessel while departing from Crab Island. [Redacted] was seen in actual physical control of the vessel by operating the trim motor and driving the vessel away from the Island. When asked for a driver’s license, [Redacted] provided it and stated he had a boater’s license but did not have it with him, claiming his dog ate it. While speaking, [Redacted] continually used the seats for support. When asked to show life jackets for everyone on board, [Redacted] appeared confused and stayed still while others in the vessel searched for them. Once found, [Redacted] held up one life jacket but seemed confused when asked to show one for everyone on the vessel. [Redacted] incorrectly stated there were seven people on the vessel, while the observer counted eight. One occupant admitted forgetting to count himself. [Redacted]'s movements were slow and sluggish. After observing multiple signs of impairment, both vessels were maneuvered out of regular traffic towards the beach on the Eglin side of the bay for a more stable inspection area. When asked if he had anything to drink, [Redacted] denied it, despite the presence of empty beer cans and boxes and the smell of an alcoholic beverage from the vessel. The observer checked [Redacted]'s eyes, asking him to follow a green light on a pen with his eyes while keeping his head still. [Redacted] struggled to follow the light and later a finger, failing to follow simple instructions. During this time, the smell of an alcoholic beverage was noticeable on [Redacted]'s breath, and his eyes were bloodshot and glassy. [Redacted] was asked to step to the patrol vessel for field sobriety tasks, which he agreed to. Based on observations of the vessel in motion, personal contact with [Redacted], and his performance on the sobriety tasks, [Redacted] was placed under arrest for boating under the influence at 1620 hours. [Redacted] was handcuffed and seated in the front of the patrol vessel, and a 20-minute observation period began. The vessel and its passengers were released to return to the rental company. [Redacted] was taken to the USCG Station Destin via the patrol vessel. When asked if he would provide a breath sample, [Redacted] refused. Officer Heath Nichols, a certified breath test operator, operated the Intoxilyzer 8000, and [Redacted] again refused to provide a breath sample. [Redacted] was transported from USCG Station Destin to the Okaloosa County Jail in Fort Walton Beach, Florida, without incident. He was issued uniform boating citations for refusal to submit to blood/breath/urine testing and operating a vessel while normal faculties were impaired.
