Hello, Sheriff's Office. How you doing today? Good. I just need license registration proof insurance. Just, you know, stop being recorded. Okay. Uh, do you know why I'm stopping you today? Uh, no. So, there's a couple reasons. The first one, when you made the turn off of Monroe on the Stadium Way, you turned in the far outside lane, the far right lane. got make that turn the nearest lane possible. Uh and then when you made the turn off on Grand, you had the red light. Before making that turn, you got to come to a stop and then turn. You just coasted right through it. Essentially running the red light. Um where you coming from tonight? I'm literally just going to a friend's house. I'm supposed to get your turn. Okay. And you said you're going to a friend's house now? Uh no, I'm going home now. Okay. Um and then it is Maya, correct? Mia. Mia. Okay. Sorry about that. Um, how much alcohol have you had to drink tonight? Uh, I've literally had like nothing. I've had one drink. One drink. What was the one drink? It was um a shelter. Okay. How long ago was that? Um, like 9:00. 9:00. 9:30. Okay. So, you're looking at like 4 hours now, right? 4 and a half or so. Okay. Is it okay if I take a picture with your eyes? Okay. So, can you see my finger where it's at? Yeah. So following your finger with your eyes only. Keep your head completely still. Does that make sense? Okay. All right. Go ahead and re the vehicle. Be right back with you. Mia, can you do me a favor? Hop out of the vehicle real quick. Do you have any weapons on you at all? Uh, no. Okay, perfect. We'll go and watch the front of your vehicle. Okay, we have more space up there. Is there a nice shoulder over there? Yeah. Okay. Well, go this way. Sorry, I didn't realize there was a nice path there. It gives us far away from the road. Okay. Yes. So, the reason why I'm asking you to hop out of the vehicle, look in your eyes, I can tell you've had more than the one Celsius to drink. Okay. Okay. I'm ask you to be honest with me. How much alcohol have you had to drink through the entire night? Through the out the entire night, I probably had like three shots. Three shots. Okay. And the selzer or is that just three shots? Uh, three shots and the Okay. But how long ago were all those shots? Uh, like around 9:30 10. Okay. So, all those around the same time. Where were those at? uh at my friend's house. Okay. Okay. Um so here's the deal. Whenever someone's told me they've had alcohol to drink, whether it's a little or a lot, little less is than what you're telling me, my job is to ask you if they'd be willing to do some voluntary field sobriety tests. Do you want to do those tonight? Sure. Okay. Um lights were off. Do you have any injuries at all that you know about? Um no, I have knee problems, but on which knee? Uh my left knee. Left knee. Okay. I'll keep that in mind. Does that bother you now or is it hurting at all? Um not at the moment. Okay. Um, do you wear glasses or contacts? Um, I wear reading glasses. Reading glasses. Okay. Do you need them to see regularly or just for reading? Just for reading. Okay. Um, then if can that jacket button up or zip up at all? Uh, it does zip up. Okay. If you like to do that now cuz some parts you have to keep your hands to your side. Okay. Once you start staying warm as possible, I know it's cold. Okay. And just aware all these tests are completely voluntary. They can be stopped at any time. Okay. up. Can you see my pen where it's at? Okay. So, I want you to stand your feet together, hands to your sides, follow the pen with your eyes only. Keep your head completely still. Okay. And you can blink whenever you need to. Okay. Continue to follow pen my fingers out. We're just going be going up for this one. Okay. Okay. All right. Next test. Now, walk in a straight line. Um, can you stand where my light is facing straight towards me? Okay. So, what I'd like you what I'd like you to do is imagine a straight line going infinitely out in front of you with your left foot already on that line. Go and place your right foot heel to toe in front of your left and stay right there. Nope. Stay right there. So, this is the starting position for the test. I want you to remain this position. Do not begin the test or step out of this position until they've asked you to begin the test. Does that make sense? Yeah. Okay. For this test, you'll take nine heel to toe steps along that line, keeping your arms to your sides, looking down to your feet and counting each step out loud. After your ninth step, you'll take a series of small steps around your lead foot. Take nine heel to toe steps back along that line. Keep your arms to your sides, looking down to your feet, counting each step out loud. It's going to look like this. One, two, three. I took three. You're going to take nine. Okay. Yeah. Step out that back foot. Take the shoes of small steps around your lead foot. And one, two, three. Back along that line. Once again, I took three. You're going to be taking nine. Okay. It's important to know once you begin the test, you cannot stop or pause till you feel you are completely done with the test. Does that make sense? Yeah. Okay. Go ahead and begin whenever you're ready. One, two, three. Four. 5 6 7 8 9 1 2 3 4 5 6 7 8. Go ahead and turn back. Face towards me. Keep your feet together. Hands to your sides. This is the starting position for the next test. So, don't raise any of your legs or feet and don't begin the test until I've asked you to do so. Okay. So, for this next test, whatever leg you're most comfortable with, whether it's your right or your left, I don't care. You'll lift it approximately 6 in off the ground. Keep your toe pointed straight out forward. Keeping both legs straight and your arms to your side, both down to your raised foot and count out loud. 1,00 1,002 100,00. Okay? If I count to six, keep going. I'll let you know when Okay, go ahead. No, not just deny yet. Go ahead and begin whenever you're ready. 2009. 2002 34 2005 2006 2007 2008 2009 2012 2011 2012 2013 2018 2016 2018 2019 2020 2021 2022 2023 2024 and Okay. So, this last test, the preliminary breath test, this is not movie evidentiary breath test. Like everything we've done, it's completely voluntary. Okay. Have you ever blown up a birthday balloon before? Um, yes. Rubber birthday balloon. Says just like that. Take a big deep breath in, have your lip seal around the straw, and blow directly in the straw for about 3 to 5 seconds. Okay. Okay. So, whenever you're ready, big deep breath in, and blow into the straw. You got to have your lip shield around the straw, just like a balloon. Okay. Yep. Keep going. Keep going. Keep going. Keep going. No, you start. So, you start blowing in and then you sucked in. You got to only blow into the straw. Okay. Okay. Okay. Whenever you're ready. Blow. Blow. Blow. Keep going. Keep going. Keep going. Keep going. Keep going. Do the same thing. The same thing. So, you you start blowing and then you sucked in a little bit and started blowing again. So, we'll do one more time whenever you're ready. Okay. I clicked it really quick. That way, it wouldn't do the same thing as them last two times. So, you are 20 or 20 or 19? I'm 19. 19. Do you know what the legal limit to drive in the state of Washington is if you're 19? Uh, I'm sorry. Can you say that again? Do you know what the legal limit to drive in the state of Washington is if you're 19 after consuming alcohol? Um, no, I don't. So, it's 02. Mhm. I would ask if you'd be above it or below it. We already know you're 108. Okay. Uhhuh. You were five times the legal limit for someone your age to drive a motor vehicle. Okay. So, go ahead and place your hands behind your back right now. You're under arrest for DUI. Um, okay. So, I'm going to advise you of your rights real quick. Right now, you have the right to remain silent. Anything you say can be is against you in a court of law. You have the right to the presence of an attorney during questioning. And if you cannot afford an attorney, one will be appointed for you prior to questioning if you so desire. You can decide at any time to exercise these rights, not make any statements or answer any questions. Do you understand those rights? Yes. Okay. Um, so a couple questions. She has somebody that can come get her. Are you good if they take your car? Yes, they can. As long as somebody sober's driving. Yeah. Okay. All right. Um, so I'll explain you what all is happening. We're going to be going to Pullman Police Department. They have some more testing there and some more papers we got to go through. Um, I'll explain all that more once we get there. Is there anything you want going with you as far as phone, wallet? She will probably leave the car. My phone with me. Okay. And well, is it maybe on you or in the car or in the car? One of the two. Okay. Yeah. Um, how about wallet? Um, my wallet's in there as well. Okay. Anything else besides those you want like to go with you? Um, no. As long as my all my cards are in my wallet, but my fanny packs in there with some of my cards that are outside of my wallet. Okay. So, I don't want to be searching through everything. Is it okay if I just grab fanny pack and wallet? Uh, yeah. I'm And also the girl that's in there should know where everything is as well. Okay, perfect. I just I don't like searching through people's stuff if unless I have like a reason to. Um, so you see the 911 in the back of the car. We'll walk straight to that. Can just stop and face that. Okay. Do you have anything in your pockets? All I need to know about um I just have like the lipstick in my pockets. I'm pretty sure. Is it jacket pockets or pants? It should be in my right here. I have Oh, okay. And that nothing else in any of the pockets? No. Using back my hand to check everything. I'll get this pencil from you. Nothing in back pockets. You don't have a hood on the jacket at all. No, I should. You want these everything we got off you to go just to go in the car? Yeah, that's fine. Okay. You want to take a seat in there? And I'll be right back with you here in a bit. Okay. Okay. Go ahead and hop out. Then if we head up here and then to the right. Do I need you to hold you the whole time? Are you going to try to run from me? No. Okay. I would hope not. I haven't had anybody run, but first for everything. Odd doorways in front of us. the one with the orange paper. We'll go straight to that. Just a small room there. And then I'll meet you on the other side. Heat. Heat. Okay, come through here. It's time to take a seat in this that chair there. So, this package is all the paperwork I mentioned before. Uh, I look the same thing on my tablet. My handwriting is horrible, so I do it all electronically just so you know what I'm looking at here. Okay. Okay. Um, this is probably the most I'll be talking about that this part here. I can read from here down to here. You can either read it yourself, so ignore me, follow along, or just listen to me read it. It's completely up to you. Uh, this is your implied consent warning for breath warning. You're under arrest for RCW 4661502 or RCW 4661504 driving or being in actual physical control of a motor vehicle while under the influence of intoxicating liquor and or drugs. I apologize. Out of these three boxes, I'm checking the top one. Further, you are now being asked to submit to a test of your breath, which consists of two separate samples of your breath taken independently to determine alcohol concentration. You are now advised you have the right to refuse this breath test and that if you refuse, A, your driver's license permit or privilege to drive will be revoked or denied by the Department of Licensing for at least one year and B, your refusal to submit to this test may be in a criminal trial. I have read or have had read to me the above statement. Yes. Okay. And will you now submit to a breath test? Then do you have any questions about anything we've done so far? Anything we're we need to do? Um I just what happens like after this when we like the test and probably the one question I can't really answer. Um so once we get to that point I'll I'll keep that in mind. I'll make sure to let you know. Okay. And then is this something that I'll have to pay for or go to court for something? Okay. Yeah. So, no matter what, you'll be going to court on this. Um, you'll most likely have to go to court Monday, next Monday, for a first appearance. Okay. And sorry, I did that. um for first appearance and then after that there may be some other court dates down the road. It's just completely up to the judge and what happens throughout the legal process has nothing to do with my end at that point. This page has questions to go through. Um you answer them the best you can or don't answer them at all. It's completely up to you. A lot of them may seem pretty obvious close to you. A lot of them may seem pretty obvious or self-explanatory. I get a lot of weird looks. Just kind of got to roll with it. Okay. Uh do you have any physical impairments? No. Where do you currently work? Um unemployed here. Okay. Just student? Yes. That works. Have you had any alcohol to drink since I stopped you? Yes. Or since? Sorry. Since I stopped you. No. Okay. I keep I keep waiting for someone to stick to yes on that one. And I'm fired. And where you where were you going before I stopped you? Home. Without looking. What time do you think it is? Um around 1:45. And have you been drinking alcoholic beverages? Uh I was. Yes. What were you drinking? Uh, I had sensors and shots to tequila. About how much? Um, like I think it was three. Three shots. Three shots. Yes. And you said just a one cell. Yes. And when did you start drinking? um 8:50 I want to say it was around that time. And roughly what time was your last drink? Um around 10:00. Do you believe your ability to drive was affected by alcohol and or drug usage? Uh most likely. And have you ever been arrested for DUI before? No. Okay. I think I could have guessed on the answer to that one, but you never know. All right. So, here in a bit machine will be ready for the breath test. Um, when we do that, I'll have you stand up just cuz it's easier to actually big deep breath in. Um, then just keep in mind it's got to be like 10 seconds. So, don't want to blow all the air out too fast. You can go ahead and stand up. Tell if you see where you're standing. Did you see the There's like a dotted line here. Mhm. Be two lines, a red and a blue. You got to keep both of the red and blue above the dotted line. Okay. It's got to go for about 10 seconds. So, whenever you're ready, big deep breath in, lips around the straw, and blow up. Keep going. Not blowing any. There you go. Keep going. Keep going. Going going going going going stop. All right. You got to do that again. Like this. Um I should go harder that first. Okay. Yeah, a little bit harder. Yeah. It wasn't registering any air at all. Yeah. Yeah. And that need usually takes 5 minutes or so to actually go through the whole thing or not. Okay. Okay. Big deep breath in whenever you're ready. Got plenty of air. Keep going. Keep going. Keep going. Keep going. Keep going. Plenty of air. Keep going. A little bit more. A little bit more. A little bit more. A little bit more. And stop. Perfect. Okay. So, you got one more of those. That was good. Okay, let's go ahead and stand up again one last time hopefully. Okay. So, whenever you're ready, big deep breath in. Okay, plenty of air. Just keep going. Keep going. Keep going. Keep going. Keep going. Keep going. About halfway. Keep going. A little bit more air. A little bit more air. Keep going. Keep going. And stop. All right. So, here's the breath results. It's measured two different ways with two different samples. So, uh first sample measured with IR the infrared result of 0.087 with an EC electrochemical result of 0.087. Second sample down here with an IR infrared result of 0.093 electrochemical result of 0.091. 091. So for everything moving forward, all court documents, legal documents, everything, they're going to use the lowest of the four, that 087. Still above that legal limit to drive, even for someone who's above 21. Uh what's going to happen now is you drive to the Whitman County Jail there in Kfax. You'll get booked into the jail there. And then since it's your first DUI, after that you can bail out as soon as you're booked in. So as long as you have a ride to come get you or I mean you can bail out and pan or a lobby if you'd want. But as long as you ride then you can bail as soon as you're there. It's cuz you're still over legal for someone over the age of 21. It's full DUI. Uh the bail amount is $1,000 and then once you go to court you get a portion of that back. Believe it's the majority. Um, as long as you go to court. If you don't go to court, you lose at all, and we had to come find you with a warrant. Okay. So, well, the check yesterday, she was cooperative, didn't fight me, and I did not place her back in handcuffs. Give you the same option. I mean, you've been cooperative. You have no fighting at all. Okay. Don't need to put you back in handcuffs. I know they're not exactly the most comfortable thing in the world. And you have no weapons on you at all. No drugs. Okay. It's about 15 20 minute drive to cool effects. Uh, are you sure you do not need to use the restroom at all? Okay. Okay. Done with water. Okay. So, go back in this room and I'll meet you on the other side again. Okay, come through here. We'll be heading back out the car. I think [Applause] Okay. It's a bit of a longer drive since you put the seat belt on. Boy, do you guys enter in Chloe's information? Huh? Do you guys put Chloe as the driver or No, we got Chloe. That's who he thought was arrested. Oh, yeah. No. Uh, passenger stand. I was going to try to clear it up, but what I said I was going to try to clear it up on the way here, but what I said yesterday seem to confuse you guys more. So, I decided not to do it again. Um, have you ever been contacted by Pullman PD yet or WCU? No. Okay. So, first thing I'm going to have you do, do you have a shirt on to do that? Okay. I'll have you take the jacket off and then you got to take all your jewelry off. So, you're going to take this jumpsuit, head into the restroom right there. You have to take everything off. No bra, no shirt, no pants, no underwear. Just that. And then bring your clothes back out. We'll give you the underwear, your bra back after we do the scan. Okay. Come out like that. Get changed. [Applause] Learn from us as much as you can. Huh? Learn from us. I'd be talking to you guys. Head right into that room to finish up and stand right on the yellow line. looking at that red dot. Okay, look right at that red dot. I'll have you back up like two or three steps. There we go. All right, step up onto the little feet markers there. Put your hands to your side with your palms facing backwards just like how I'm doing it. Perfect. And just [Music] so Heat. Heat. [Music]
