All right. Are you wearing contact lenses right now? All right. Do you have any kind of medical conditions with your eyes of any kind? All right. Any inner ear balance problems? Have you taken medication for anything? I do. I take Okay. Um have you taken that today? Yeah. All right. Have you um had anything to eat before you did you eat before you had the alcohol? If you would stand up off the bumper there for me. Stand with your feet together, heels and toes all the way. Just keep your hands down at your sides for me. Okay. What I'm going to have you do, just like you did before, I'm going to have you follow the tip of my finger right up here at the top. As I move it back and forth, just follow it with only your eyes. Don't move your head. And keep your focus on my finger until I tell you to stop. You understand? Sure. Yes. You can blink at any time during this if you need to. Okay. Heat. Heat. Can you see my finger? Okay. Okay. Just keep your focus on it. Okay. Can you see my finger? M. I'm sorry. No. You can't see my finger in front of your face. Yeah. Hey, you all right? Sit up. Sit up. What's your name? Oh, God. Sophia. Okay. All right. What's the matter, Sophia? I'm scared. You're scared? Okay. What are you scared for? Just you. Well, why are you scared of me? I don't know. Okay. All right. Just calm. Just sit there and take a breath for a second. All right. I think you just pissed yourself. You sure you're all right? Scared. What are you scared for? My mom's going to get me in trouble. What is your mom going to get you in trouble about? This. This? What's this? Am I going to get a ticket? Well, I mean, we still got to get through the rest of what I got going on here. But, I mean, from what I've seen so far, you have no business driving a car tonight. That's for sure. Do you need me to call you a squad or are you okay? No. Okay. All right. Just collect yourself. I know. I I am. I don't know what's happening. Okay. Right now, I'm just want you to sit back against the car and just rest for a second here. Okay. I don't want you to pass out on me. Yeah. Why am I feeling like this? I'm Well, that's a a nervous reaction. It's an involuntary reaction to a moral person doing an immoral thing. So basically, you know what you're doing is wrong and you're starting to feel guilty all of a sudden about it because you know you're not doing you are sitting down. Just you want to sit all the way down. Yeah. Come around here. I'm going to have you sit down in the back seat here for me. [Applause] Just keep your hand against the car so you don't lose your balance. All right. Okay. Stand up. Stand up. Come here. Have a seat. You all right? Okay. Just relax for a second. Okay. Starting to swallow. I got a females pass out. Union zebra 55339. Union zebra 55339. I'm going to call this just to come check you, make sure you're okay. All right. Just have just sit here and just breathe. Okay. Did I just ruin my life? What's that? Did you say did you ruin your life? No, you haven't ruined your life. What I mean? My mom said if I ever did I would Okay. Well, right now don't worry about just sit back, relax, and breathe. Okay. I can't. I can't. Cuz you've collapsed a couple times on me here. Do you have like major anxiety issues? Yes. Okay. Okay. All right. Okay. You feel like you're having an anxiety attack right now? Yes, but I'm okay. Okay. All right. What's going to happen? Well, we're right now I'm going to get you checked out first and then we're going to go from there by a squad. I want to make sure there's not a medical issue larger going on. Okay. Okay. Sounds like it's going to be a panic attack. What is it? You don't have a panic attack? I haven't won though. Okay. Well, you've collapsed twice on me now. I know. I I feel I've been like super I got super nervous and I got Has that ever happened to you before? You passed out like that or collapsed? No, but I've had anxiety attacks before. Okay. I got I just got super nervous. I don't know why. All right. Well, still for your safety, I want to make sure you're okay above anything else. That's the most important thing right now. Okay. Okay. Yes. All right. Just all I want you to do right now is just sit down and breathe. You lost your shoe there. If you want to grab Thank you. Oh my god. All right. So, I'm not going to lie to you, okay? I've already got enough to tell that you shouldn't have been driving your car. So, I'm going to charge you with OVI tonight. Okay? I'm going to take you back to the post. I'm going to process you for that OVI. I'm Listen, I'm not going to take you to jail. Once I'm finished with all the paperwork and stuff, I'll let somebody come and pick you up. Okay? Anyway, but I mean that's that's what's going to happen one way or another. Do you have to go license? Well, that depends cuz I'm going to offer you I have I didn't even have that much. I I don't What What did you take me for? U a speeding. Yeah, that's what I stopped you for is your speed. And how much was I going? 86. 86 and 65. Mhm. Check the 84 84 and 86. So, between the alcohol and the THC, you definitely shouldn't been driving the car. Well, I didn't have the THC recently. Okay. Well, I mean, you said that you smoked it like an hour ago. Yeah, but I don't feel anything. I understand. Well, like I said, I'm just going to I'm going to have you checked out by the squad first and then we're going to go from there. Okay. What about my light? Oh my god. So, when we get back to the post, I'm going to offer you testing if you take post number my where I work, my post, my office. Okay. Um I'm going to read you a form that will explain the consequences for taking and refusing the testing that I'm going to offer you. But essentially, if you take the test and you test at or over the limit for alcohol or drugs, your license will be suspended for 90 days. If you refuse to take the test, then your license will be suspended for a year. Does that make sense? Okay. But for right now, I don't want to keep explaining all this to you, making you more nervous than you already are. Like, right now, I just want you to collect yourself and relax. Okay? Yeah, she just collapsed in the middle of HDN. Then she was okay for a minute and then I was going to have her come back here and sit down. And then she flaps on the way back to here. She's just got some anxiety issues. She says she's okay, but I'm still have squad check her out just to make sure. No, she Yeah. Still don't hurt. What's that? Am I going to have to call my parents? Well, you um you're old enough that you can call whoever you want to come and pick you up once we're finished with everything. Did you scuff your leg or was it already scratched up? No, I'm good. Okay. Um, you can call whoever you want to come and pick you up once we're finished with everything. Doesn't have to be your parents. It's totally up to you who you call. And then your vehicle, we can lock it up here. I can tow it, whichever you prefer to a tow truck yard instead of leaving it on the side of the road or we can leave it here and you can come back and make arrangements to pick it up within 48 hours. That's what most people do. But if you're not comfortable with that, then I can have it towed if you prefer. But if two people, if you can call two people to come, one to come and pick you up and another person to drive your car, then you can get your car and get it taken home tonight. But, you know, either way, you're not going to be able to drive home tonight. But like I said, before we get to all that, I want to make sure you're healthy and okay first. Yeah, I I thought it was, but then I just I mean, you were there for a minute, but when I was doing that eye test on you, you just like you literally zoned off into another world and you just fell into me. I about caught you, but then you dropped to your knee and just collapsed. I got you stood back up and sat down. You're okay. Then walking around here, same thing happened. You just like stared off into black and I started getting too nervous and I felt like I don't know what kind of does that happen. Some people Yeah. I mean, some people just react that way to nerves when they get like really really nervous all of a sudden like that. It's It's not the first time I've seen somebody. That's why I knew exactly what was going on. Sometimes they will go down one time like that and then they're okay. Then you started getting a little queasy again. So, you wanted to sit down. So, I wanted to bring you back here so it was a little more comfortable and slipped out of my grip again. Got some pavement right there. You sure you're all right? No, I'm okay. Okay. All right. Well, like I said, I'm just going to have them check to make sure you're not like had any heart issues or nothing else. You know, that's the important thing. And then we'll we'll go on from there. Okay. Once they're finished with checking you out, there shouldn't be too much. What is it? Is there something else you could tell me about about anything? I don't know about like this process for this what's going to happen or what I should do or anything I should know. I mean, I can't give you legal advice obviously, but um like so as far as like the paperwork and stuff goes, you'll uh I'll issue you a court date within five business days. It'll be uh basically next Friday at 8:30. You'll have to appear in court for it. Then um you'll enter a plea of guilty, not guilty, no contest. And then if it's not guilty or no contest, you'll have a couple other court appearances after that. If it's uh if you plead guilty, then they'll set it out for sentencing and you'll only have to come to court one more time. So what about my like license? Are you taking it away? So that depends on, like I said, the test that I'm going to offer you if you take it and what the results are and if you refuse it. Well, can I ask somebody about that? Ask Can I call somebody before I do this? The only person you'd be able to call would be an attorney. Okay. All right. So, so that's what normally people do is just do it. Yep. Okay. Or or you know, one way or the other. Some people take it, some people don't. I just can't do or say anything to persuade you. Either way, it doesn't what decision you make has no bearing on whether or not you go into jail. Your your behavior and your level of cooperation. That'll change that. I said the only thing that'll change whether or not you go to jail is your behavior. Like if you like try to fight me or something crazy like that. That's right. So like with you being cooperative and everything, it's not something I would take you to jail for. Unless you don't have you've never been arrested for OBI before, have you? Okay. So, yeah, if you don't have any prior, then it's not something I take you to jail for in the first offense, especially with you already having anxiety issues that going to jail probably would just exacerbate that. Oh, not a whole lot. So, I was doing uh field sobriety on her and she just stared off into space, lost consciousness, and dropped down on me. Okay. Brought her back here to sit down. She said she's a little queasy. She dropped a second time on the way back here of the car. She's got anxiety. She takes Lexapro and what else? Soie. And what is it? Soie. Soie. So, plus. All right. Well, they're going to check you out and make sure you're okay here. So, just do whatever they have you do here. A few moments later. At this point, everything's checking out more room for me. Sophie, you don't you don't want us to take you up to the hospital or do you? No. No. You sure? I don't feel like I need Okay. Okay. Okay. Is there anything else I can do for you guys? Well, I mean, you and I still have business obviously, but I my main priority is your health and safety, you know. So, as long as you're okay and you don't need to go to the hospital, then they're going to go about their business and you and I are going to wrap up ours. All right. Appreciate it. No problem. Take care. [Applause] So, feeling okay now. I mean, I I get the circumstance. Yeah. Right. Circumstance aside, physically, you feel like you're okay. All right. Do you want to try? I mean, I don't honestly I don't even want to try to have you do any more tests cuz I'm afraid you pass out again, you're going to hit your head on something like I don't want to put you in a situation where, you know, if your anxiety ramps up again. I can, but if it can, honestly, at this point, I really I don't need it. So, I would rather just air on the side of caution. Um, so at this point, you are officially under arrest for OBI. I'm not going to put the handcuffs on you. I do need to do a search just to make sure you don't have any weapons or anything on you. So, if you would just stand up for me real quick. We're going to come back up to actually just stay right here. I don't want to take a chance on the phone. Just set your hands behind your back here for me. Keep them right there for me. You don't have anything inside your pockets or anything, do you? Okay. You have anything on you going to poke, stick, or hurt me in any way? King Victor. So, like I said, I'll I'll lock your car up. I'll get your phone, purse, wallet, or whatever you got in there. Um, and obviously the keys for the car. I'll move it over a little bit more so nobody gets it. lock it up here. I'll take you back to uh my office there at Bavia. Um we'll do the paperwork and stuff and then um once we're finished with everything um you can call and then go ahead and buckle your seat belt for me. head and sand. Walk around the front side of the car and up to the wall there where that fire extinguisher is mounted at over here to the right side of the door. Little more. Watch your step coming up here. The end of the carpet down there. Turn left and then the first doorway past that shelf. Just have a seat on that bench straight ahead for me, please. So, this is the form I was talking about. I had to read to you. Here's a copy for you to follow with. I'll be start this top paragraph up here. This is going to explain the consequences for taking a refusal test. You now remember 45119 operating a vehicle under the influence of alcohol or drug or a combination of them. If you refuse to take any chemical test required by law, your Ohio driving privilege will be suspended immediately and you'll have to pay a fee to have a privilege reinstated. If you take a chemical test, you may have an independent chemical test taking. So, basically what this says is I'm going to offer you a breance. Okay? If you take the test and the test at or over the limit, you'll have a 90day suspension of your driver's license. If you refuse to take the test, then you'll have a automatic one year suspension of your license. So, three months if you take a test over, one year if you refuse to take it. Does that make sense? Yes, sir. You have any questions on that? Okay. It, like I said, they it goes both ways. Sometimes they do, sometimes they don't. Everybody has their own reasons for it. All right. So, how this machine works, it's going to take two breath samples from you. If there's any difference in between the value of those test, the lower of the two will be your official silver. So, it gives you the benefit of your doubt. Um, when it's ready, I'll put my mouthpiece on there. Just place your lips around the end of this mouthpiece. You got to take in a big deep breath, feel your lips around it, and blow one continuous stream of air until I tell you to stop. It takes about 10 seconds. So, once you start blowing, I'll count down from 10, and that'll tell you to stop. So, basically, just blow as hard as you can. All right. It's going to be a couple minutes before it's ready. After your first sample, there's about three before the next. So you have a little time to catch a breath before you have to do it second time. Take a deep breath and boil water. 9 8 7 6 Take a deep breath not to start overflow 9 8 7 6 5 4 3 2 1 stop for a sec. We'll do the same thing in about 3 minutes. sing. Take a deep breath and lower. 9 8 7 6 5 4 3 2 1 Stop. Heat. Heat. All right. You can see your alcohol attaches to 131. So you are the limit. 08. So if your sample was over the limit, your license is going to be suspended for 90 days starting. I have to read this bottom portion of the form here to you. Independent of any penalties or sanctions imposed upon pursuant to any other section or vise to the municipal ordinance, your driver's license or commercial driver's license permit or non-resident operating privilege is now suspended. So for uh the next 90 days, you will not be overdrive. Okay. All right. So this your citation here. Okay. your court date set for next Friday at uh 8:30 Claremont County Municipal Court and it's mandatory appearance decided to for the speed 86 and 65 and they'll be uh if you have any questions about anything or some emergency occurs on this day you're not able to make it for whatever reason of course healthare numbers here you can call them and make a rank and let them know ahead of time. What's the common outcome for this? Um so typically on a u our first offense cooperative person they will typically offer you a reduction of a what they call a third reckless operous operation with higher fines but not actually a conviction of OBI. Okay. Typically, now I can't say for certain that's going to happen for your case, but what type of cases does it happen with? People who are cooperative and it's their first offense. You know what I'm saying? Yeah. All right. So, I can't tell you that's going to happen in your case, but typically in these situations, that's what happens. So, okay. All right. there. I I have no reason to believe that that would not be the case for you because you've been cooperative and everything, but I'm not going to sit here and tell you that's for certain what's going to happen with you cuz I don't want you come back like what he said. You know what I mean? Like cuz at that point it's entirely up to them. Is it still 99 times out of 100? That's why. Okay. Okay. Is it still 90 days no matter what for your suspension? Yeah. Correct. That's separate from this. This is through the court. Your suspension is through the B&B. Okay. So, all right. Second uh paper here is a your copy of the your breath test print out. So your first sample when you blew in the first time was a 137. The second one was a 131. So because that one was a lower one, that was your official score. But your first sample actually was a little bit higher than the second one. Did that happen by 6,000? Yeah, it's pretty standard that there was a slight deviation between the two of them. You just had probably had a little bit higher volume. So yeah, so your breath your breath volume is 1.988 L and this one's 2.113. So this one's actually a more accurate number because it's a deeper lung air sample, but because you blew just a tad bit less on the second one, it didn't register as deep or as high of a DAC legal is what 0080. Yeah. So you just missed like this one right here was 3,000 short of double legal. Well, actually no, there was 16. So yeah, so you're you're much closer to double the legal limit than just over the limit. I mean, so and then third copy here is your copy of that form and I fill over your license suspension. Your physical driver's license, I would have to send up with that form to the B&B. So you will not be getting that ID card back, your license card. In about a week and a half, two weeks, you can go to the B&B and get an ID card if you need one for like ID purposes or whatever. But if you try to get one before that, they'll make you relinquish your driver's license completely to be able to take the driving test all over again. They have to have the suspension on file before they'll let you get an ID card when you're under suspension. So, wait about 2 weeks before you try to go to if you need an ID card. If you have some other form of picture, photo ID for something. I do. Okay. Then you then don't worry about it. But if for whatever reason you needed to get him an ID card, um you would need to wait at least two weeks before you try and do that. What's just wondering what's the worst outcome in this situation? Worst outcome, you go to jail for 3 days. um you pay about I'm going to say $800 in fines and court costs and um you can have another 90-day suspension of your license on top of a 90 that you already have through the court. Actually, I think it's 6 months, but it's typically it's arranged through the court for this. That's not going to happen in this on a first offense cooperative person. Like I said, it's typically so this like mess up works, right? I don't know what you're I mean until you get to this person once you go to court the first time and it's heard in court, you'll be able to request driving privileges from the judge. So for work, for work, grocery store, doctor's office, that sort of thing. um write down like the times that you go to work and like a time that's good for you to go to the grocery because they will specifically map out days of the week and hours of those days of the week that you'll be able to drive. And if you're caught driving outside of that for any reason, you're going to be in even more trouble driving under an OBI suspension outside of your curriculum. So, you definitely don't want to mess with that. They'll take your license plate for a couple years. I don't want any of that. No, I understand. Um you're not a bad person. just made a bad decision. Yeah, that's all it was. So hopefully it's a learning lesson and we'll we'll do it again. Y a lot a lot of people don't realize where the legal limit actually is. They're like falling down drunk. I I feel okay. It 008 happens way before that point where you're like can't stand up, can't talk. So those cliche commercials they say where it's like buzz driving is drunk driving. there. It's totally true cuz 0.0 the legal limit happens way before people realize. How many drinks is 08? Like one. It's different for different people. Your body size um your metabolism an average person uh like a average size man 51 6t 180 to 200 lb. Four drinks is going to four drinks is going to put you right at it. Um so all right. And you and it's also within a sort of time frame. You know, you drink four drinks over 6 hours, it's a whole it's a lot different than drinking four drinks in one hour. So, the concentration and the time that it's consumed, your metabolism, your body size, you know, it's a percentage of your blood. So, the bigger being smaller is that big you being smaller, you just, you know, three drinks is going to probably put you there, somebody your size, even if I had it long enough, but just depends on how many you had, how big they were, what type they were. you know, you there's a big difference between drinking a wine cooler and taking a shot of Everclear. So now you're looking at the concentration of the alcohol versus by size and there's a lot of factors that go into it. So for me to sit here and say three drinks for you is a very broad estimate, right? So um Okay. And best case scenario, best case scenario is what I said before. or a third reckless um instead of going to there's a mandatory 3-day jail term with this with an OBI if you're convicted. Now, what they do in lie of having you actually go to the jail and physically sit there for 3 days is they send you to a 3-day driving intervention program. So, it's a class you go and learn about the effects of alcohol and drugs on your body driving. Will I be able to do that instead of you absolutely will be able to do that. They want you to be a productive member of the society. They want you to be able to go to work and do all the stuff you need to do. and we're going to give you driving privileges. They're going to let you go to that class instead of go to the jail cuz we got a whole lot more other dirt bags we need to put in the jail and to clog it up with people who made a bad decision like you to sit in there for 3 days. We don't have room in the jail to put nice people who had too much to drink one time in the jail. You're not going to have to go to jail. I can tell you that. Okay. Um you will get that 3day driving intervention program. Um that's Yeah, it sucks, but it's better to sit in jail for days. So less than that. Yeah, that's true. Um, other than that, it's one step at a time. You know, go go to this hearing. You'll either be assigned a public defender or if you have, you know, the financial means to hire your own attorney, you can do that. Um, what would they do for you though? Like a public defender? Yeah. Like it's an attorney that they will sign you that at a significantly reduced rate versus hiring direct, right? But I already I mean I I already am guilty for blowing past the legal limit. So what would they really be? There are things that they can present and try to fight in court. So it's you know it's it's my word versus theirs. So proof I have to pro it's a burden is on me to prove that I had probable cause to stop you, probable cause to get you out of the car, probable cause to arrest you, bring you into this machine. I I I did right. I certainly feel like I did or otherwise I wouldn't have done what I did. But um it's just it's procedure. It's it's innocent until proven guilty. That's how the judicial system works. So they're going to allow you the ability to defend yourself in court, present your case for whatever it's worth. I present my case. It goes back and forth, whatever. So um yeah, just take it one step at a time with this. And uh it's it's stressful. I get that. I'm sure. And you know, and already having anxiety issues is going to probably just make it a little bit worse. But um if it gives you some solace um you're not going to see the inside of jail cell for this um and you more than likely like I said in most cases they will offer you a plea deal of a reduced charge less than the OBI which would be but I'm not telling you that's what's going to happen. I'm not making I want to make that very clear. Yes I understand 99 times out of 100 happens could happen. It will it will more than likely happen, but I am not guaranteeing that it will. So, uh, go to court next Friday. Um, ask the judge for privileges and go from there. But my license is gone for not. You cannot drive until next Friday. 100% certain. Once you go to court, you can ask the judge for privileges and they give it to you at that point. They'll make it very clear when, where, and what times and all that you're allowed to drive. you will get a piece of paper that physically says the days of the week and hours that you're allowed to drive, the locations that you're allowed to go to and from, and um at that point, then you'll be able to drive. It will be very clear to you when you can drive, when those privileges are. And when school starts, will that be also that it's a lot. But it's just hard to come home. I would have stayed just to be careful. Definitely would have been the right way to go on this or call an Uber or something. But um do me a favor and tell everybody you know about this as embarrassing as it might be because you might save somebody's life or save somebody a lot of headache and that when you see somebody who's had just what they think is just a few drinks and they're about to drive somewhere, stop them. Let them know that just because you don't feel like you're wasted drunk, it's they're probably most people don't. They don't realize. And unless you found yourself in this situation or know somebody who works in law enforcement to be able to like explain it to you or a physician who could explain the physiological effects of why the legal limit is 0.08 and how much earlier it occurs than what most people call drunk. You know what I'm saying? We're adults. I'm going to talk to you like an adult. You get what I'm saying? Like it's it's it's not that point. The people that have accidents and it's the people that think they're okay and drive come to find out they were almost double the legal limit. Yeah. Exactly. So, does this happen a lot? It happens a lot. You're the fourth person we've arrested tonight. Oh, I hate that sentence. Yeah. So, um it's unfortunate. No, that's I mean, not to sound crass, but this is literally my job to find the people that are driving impaired. No, I understand it. I'm kind of past the point where I just pull people over for speed and hand out speeding tickets all day. Like, this is the stuff that really kills people. This is the Yeah. Um, you know, sometimes it's one vehicle crashes and they only hurt themselves, but the majority of the time it's it's more than one car and the other people get hurt or killed and the person that's impaired usually isn't hurt or killed or and then they have to live the rest of their life with that decision, but they made mistakes and whatnot. So, but you just don't know if you're speeding. Yep. Okay. It's that simple. Because a lot of the times the uh one of the biggest things we catch people on they're inherited speed because they don't realize how fast they're going because they're impaired. Their spa their time and space you know sensory is thrown off so they don't feel like they're driving as fast as they are. Especially with marijuana that really causes people to like everything seems slower than it actually is. A lot of times like when people are just strictly or really impaired like smoke a lot of weed we get down triple digits but another they're like I thought I was only going to say like no you're 112 and they're like I just as shocked as you are they're like are you serious? Yeah it it cuz it doesn't seem like that cuz even though things are blowing by like this to them it's just only going by this fast. So see it all the time. Where's your ride coming from? Uh about that about 10 minutes ago. Okay. So, I got one more thing I got to fill out just for them to sign and I'm turning it over to them. When they get here, I'll come get you and Okay. [Music]
