sounding jargon but basically what this is is it's advising you of your arrest for OVI okay so what it boils down to is what I'm going to do is I'm going to ask you submit to a breath sample which is you blowing into the machine to figure out what the possible BAC is okay that's essentially what this is saying okay pretty much um depending on which way you go whether you submit to it or not it could be a license suspension it depends on length of time which one okay and that'll all be explained this is a copy for you to reel along with me okay so we're going to stop start right up here at the top okay where it says consequences of test and refusal you are now under arrest for OVI operating the vehicle under the influence of alcohol a drug or a combination of them if you refuse to take any chemical test required by law your driving privileges will be suspended immediately and you will have to pay a fee to have the Privileges reinstated do you have any questions that pertain to that okay so if you see down at the bottom under the notices of suspension and the ones on the left uh that's going to be for test refusal the ones on the right will be based off of what um if you have any priors uh and you take the test so at this time do you wish to submit to a breath test or not you do okay you have that back I'll get the machine set up and we'll get you going all right Annabelle breath in keep your lips tight around the mouthpiece and we just want a long steady strong breath into the machine okay okay see the mouthpiece is enclosed I'm going open it oh is it does it look like take it um your drive like I explained to you already in the room like your driver's license you're since you're an out of state driver your driving privileges in the state of Ohio will be suspended now I don't know if Pennsylvania has reciprocity with Ohio so that's something you would have to find out you know when you're back home whether or not you still have driving privileges there but as far as you being in Ohio like you you just won't be able to drive does that make sense okay so I'm just going to be 100% honest with you I'm like I'm a senior in college right now I'm about to graduate I came here to like visit my friends whatever I I just I'm this has never like obviously never trouble stred out I understand and I totally appreciate it that's why I'm I'm making sure you understand that no I appreciate like I cannot force you to take a breath test it's up to you and I cannot tell you whether or not like which option is really like better per se I I just have to give you your options so like if you do the test um and you blow over um you know you're no matter what you're still getting charged with OVI in Ohio whether you take the test or not okay basically what happens is it determines your length of suspension in the state so like if you refuse the test it's automatically one year like you can't drive in Ohio with your license okay if because I'm I'm assuming you've never had an OVI before right okay so if you uh this might be stupid what does an what does an OVI stand like drunk driving okay driving while it's operating a vehicle while intoxicated is it like is that the same as a DUI yeah it's the same thing it's just what we call in Ohio okay okay um but yeah like I said I cannot force you to take it so if you refuse it it'll just get marked on that paperwork as a test refusal like you're still going to get charged for it you would still have to show up to court and everything for it um the only difference is is it's a longer length it's an automatic like oneyear suspension stand by she's thinking over whether or not she wants to take the test she might refuse so okay I'm sorry I'm just I I feel I'm not understand okay okay so I I don't live in Ohio I go to school in Pittsburgh I'm from Pennsylvania like I'm in nursing graduate to be nurse so I honestly I will do whatever is like the best that's like for my career because that's all I care about like I I don't I I don't know I feel like I just don't really like I don't understand it because like I said I've never I don't know okay okay yeah so like I said um if you refuse the test like like a like so here's the thing right like we don't I don't have a giant list of like every like so some states in the country like if you get in trouble in one state your home state where you reside there could be driving penalties there or not I don't know because I don't know what Pennsylvania's laws are okay I don't know if Pennsylvania has reciprocity with us as far as Ovis go some states do some states don't okay so basically like how it works sometimes is if you get charged out a state you go home and like your home state might also suspend your driving privilege some states don't honor that and it's like it never even happened but I can't tell you which way it's going to be cuz like I said I don't know what Pennsylvania's laws are all I can tell you is that if you refuse the test okay you're driving privileges within the state of Ohio that means you cannot drive in Ohio for a year okay if you blow and you're found over uh which is the 08 right which is the legal limit uh I believe it's second with no priors it would be 90 days um but either way you still going to have to go to court for it okay so my worry is like I said like I'm graduating and I like already accepted is like how I guess how can I like go about this with being I know I know you're not allowed to answer that in like a VI way okay so am I able to like call someone like my mom possibly yeah if you want to call her I'll flip around real quick like I like I said i' I have no clue how this works like yeah I'm yeah like I I don't know I don't know what to do like I'm I don't know what to do I really don't okay give me one second here said either yeah so either way you still are going to have court okay if you don't show up to court like a warrant I'll get put out for your arrest okay um I cannot tell you what ex like how exactly they'll do it but sometimes the Municipal Court here they will allow people to like do their Court over Zoom um what you would have to do is you would have to contact them first thing Monday morning and be like hey I'm out of state I was in town I got an OVI this is the date for my court date or whatever and be like hey is there any way I can do it over zoom and they'll be able to direct you more I can't answer that for you because that's a court thing okay give me a second [Applause] [Applause] all right [Applause] [Applause] going to head right back to where we were give me a second get those cups off you just relax all righty here's that same sheet again so you're saying you don't want to submit to the breath test correct correct okay so we're going to go all the way down to the bottom here okay notice a suspension all right independent of any penalties or sanctions opposed upon you pursuant to any other section of Revised Code or Municipal ordinance your driver's license or commercial driver's license permit or non-resident operating privilege is now suspended that non-resident operating privileges is going to be you okay because you're a Pennsylvania Driver is now suspended the suspension takes effect immediately the suspension will last at least until your initial appearance on the charge which will be held within 5 days after the date of this arrest or the issuance of a citation to you you may appeal the suspension at the initial appearance before the court that that hears the charges against you that resulted from the arrest or during the period of time ending 30 days after the initial appearance okay so for refusal based on having no priors it's going to be that one year okay do you have any questions on that all right so just hang tight okay I'm going to fill this paperwork out you're going to get a citation you'll get copies of both of those and I'll get you out of here all right okay that's going to be on the 25th it's next Thursday at 9 so like I told you on Monday call the court okay be like hey was in town I got an OVI is there any way I can do this uh virtually um for court it's at 9:00 a.m. okay if you do choose to appear in person um the address for the courthouse is right here okay you have any questions with that is the number on there for me to call uh if you just Google it you can get it um but this is all your information up here okay this is the only thing I'm citing for you or citing you for is the OVI it's that's the Ohio Revis code for right there okay so all I need is a signature here it's not an admission of guilt it's just you signing for receiving a copy just right up there where's that uh see this line right here see where it says signature in the X yeah now this one here this is going to that long legal form I read out to you okay it's the BMV 2255 so again this is all your information up here at the top down here is a testing information section so as you'll see OVI refused to submit to a test okay this right here was placed under administrative license suspension that's at suspension section I read you that's for one year okay so from this point on your license priv your driving privileges in the state of Ohio is suspended so you cannot drive here okay um and then this right here is just you getting a copy of this form
