On April 20, 2024, Athens Police Officer Johnson observed a vehicle traveling with no headlights or taillights. He initiated a traffic stop on the vehicle and the 22-year-old driver claimed that she did not have her driver's license with her. She also admitted to consuming 3 beers earlier in the evening. The woman agreed to perform standardized field sobriety tests (FSTs). At the end of the FSTs, she was placed under arrest for DUI. At the Athens police station, she agreed to submit to an evidential breath test, but the machine repeatedly failed. A decision was made to transport her to the nearby Ohio State Patrol (OSP) barracks in order to complete the breath test. While enroute to the OSP office, she decided that she no longer wanted to perform a breath test. She was released to the custody of the male passenger, who was in the car when she was stopped.
