Around 2:06 PM on September 18, 2024, officers with the Wall Township Police Department were called to the scene of a motor vehicle accident involving an unconscious female driver at Automotive Avenues, a used car dealership located at 5011 NJ-33. Patrolman Kelly arrived on scene and noticed that a 2024 Kia Forte had struck a parked 2016 Dodge Challenger. Patrolman Idzahl, Patrolman Baker, and Sergeant Kuhl also arrived on scene to assist. Around this time, the driver of the Kia Forte had regained consciousness, and she was identified as Emily Allen. The officers were advised by Automotive Avenues employees that a she had pulled into the parking lot before colliding with a parked car belonging to the dealership. As the officers made contact with Emily, they detected the odor of alcohol and observed other indicators of impairment. She told the officers that she was coming from Matawan and heading to work. First responders with Wall EMS arrived on scene to evaluate her further. Given her state of impairment, it was determined that Emily would be transported to the hospital for further evaluation. Before transporting her to the hospital, Sergeant Kuhl attempted to conduct the Horizontal Gaze Nystagmus (HGN) test, but he was unable to do so successfully. He also asked Emily to recite the alphabet from A to Z, but she was unable to do so. Emily was subsequently placed in the ambulance rig and transported by Wall EMS to Jersey Shore University Medical Center. Patrolman Kelly rode with Emily and she was transported to the hospital for further evaluation. At JSUMC, Emily was asked to submit a blood sample, and she initially agreed. However, she later revoked her consent so Patrolman Kelly began the process of obtaining a warrant to compel a blood draw. He contacted Assistant Prosecutor Noah Heck at 2:24 PM, and then he was put in touch with Judge Richard Leahey in a conference call. Judge Leahey granted the warrant, and Emily’s blood was drawn at 2:43 PM. After the blood draw, Emily was transported to the Wall Township Police Department. Once the officers finished processing her at police HQ, officers with the Aberdeen Police Department responded to the station and took custody of her because she had an outstanding warrant with them. Patrolman Kelly issued Emily the following citations: Operating under the influence, reckless driving, and careless driving The results of Emily’s blood draw later indicated a BAC level of 0.402%, which was 5 times the legal limit of 0.08%. ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
