#news #police #arrest #cops Offenses: DUI - Adult beverages - Concentration is 0.08g or more win 3 hours Horns and Warning Devices Report: On 10/09/2021, at approximately 2:37AM the Clarke Country Coroner, Sonny Wilson, advised via radio that there was a female in a tan sedan at the intersection of Atlanta Hwy and Timothy Road and she was sounding the horn repeatedly. He described the situation as "very animated" within the vehicle and who appeared to be filming the female. I respond to the area. As officer arrived, Wilson advised via radio that the vehicle in question pulled off at a high rate of speed headed eastbound on Atlanta Hwy. Officer observed the vehicle and made a traffic stop on said vehicle. Officer was aware that the driver used the horn improperly based on Wilson's information and officer also wanted to briefly seize the vehicle to ensure that no one inside was having an emergency. When officer approached the driver, Officer observed the odor of adult beverage coming from the passenger compartment of the vehicle. Officer asked the driver to see her driver's license and was able to identify her by her license as Miranda Jones. Officer asked Jones why she was blowing the horn on her vehicle back at the intersection and explained that she caused alarm to others. She said that she was blowing the horn to the beat of the music she was listening to. She said that "thought it was funny, but I guess it's not." Officer noticed that the driver was slurring her words. Officer asked her to exit the vehicle. Officer asked the driver where she was headed and she said "Athens, Georgia." Officer explained that she was in Athens and she clarified that she was coming from her house to Cookout to get some food. Officer asked her if she had consumed any Adult beverages tonight and she said no. Officer could still smell the odor of Adult beverages, this time it was coming from her person. Officer asked Jones if she would participate in Standarized Field Sobriety Tests and she agreed. Officer obtained the following information as a result of the test: HGN: Lack of smooth Pursuit in Each Eye (2 clues) Distinct & Sustained Nystagmus at Maximum Deviation in Each Eye (2clues) Onset of Nystagmus Prior to 45 Degrees in Each (2 clues) WAT: Stepped Out of instructional Stance (1 clue) Stepped off Line (1 clue) Missed Heel to Tow (1 clue) Incorrected Number of Steps (1 clue) OLS: No clues Total 10 clues Officer advised Jones that she was under arrest for DUI and officer handcuffed her (DL,BB). Officer immediately read the implied Consent warning card for blood and jones agreed. Officer asked Jones if she preferred to give a breath sample and she said she did. Officer read her the implied Consent warning again for breath and she agreed to submit to the chemical test. Officer transported Jones to Jail. During the first Intoxilyzer test, officer attempted to use the machine and it failed due to radio frequency interference. The second test had a 0.20 agreement issue, meaning that the difference in Jones' two samples was more than 0.20g/210L. The third test was administered too early as I should have waited twenty minutes to administer an additional test after the 0.20 agreement error. The forth test obtained indicated 0.200 and 0.201g/210L respectively. Jones consented to each Intoxilyzer test.
