Around 11:05 PM on August 14, 2025, Patrolman Anthony Bartolone with the Middletown Township Police Department responded to MJ's Restaurant Bar & Grill at 1005 SR 35 on a report of an intoxicated subject attempting to drive away. He arrived on scene around 11:10 PM and made contact with a female sitting in the driver seat of a grey 2015 Nissan Rogue. She was later identified as 22-year-old Emily Maynard. As he started speaking with Emily, Patrolman Bartolone detected the odor of alcohol and observed other indicators of impairment. Emily admitted to consuming a few sips of a margarita before attempting to operate a motor vehicle. Based on his suspicion of impairment, Emily was asked to exit the vehicle and perform field sobriety exercises. The first exercise was the Walk and Turn test. During the Walk and Turn test, Emily did not touch heel-to-toe on each step and turned impoperly. The final exercise was the One Leg Stand test, and Emily was unable to raise her foot in the proper fashion and she put her foot down before the test was complete. Based on the odor of alcohol, her admission to consuming an alcoholic beverage earlier that evening, and her inability to complete the field sobriety exercises, Patrolman Bartolone placed Emily under arrest for driving under the influence. Her vehicle was impounded for a 12-hour hold according to John’s Law. Patrolman Bartolone transported Emily to the Middletown Township Police Department for further processing. At the station, Patrolman Foy read Emily the Standard Statement for Motor Vehicle Operators, and she agreed submit breath samples. Her Alcotest results indicated a BAC level of 0.121%, which was over the legal limit of 0.08%. After the officers finished processing her, Emily was released to a sober adult pending her court appearance after he signed the Potential Liability Warning form on Emily’s behalf.
