On February 18, 2023, in Sun Prairie, Wisconsin, an officer observed a vehicle driving erratically, including striking a curb multiple times. As a result, a traffic stop was initiated. It was noted in the police report that the officer could smell a strong odor of intoxicants coming from the vehicle, as well as visually observed open intoxicants on the passenger side floorboards. The driver, identified as Jose, was asked to get out of the vehicle to perform field sobriety tests. He was searched for weapons and contraband, he stated he did not have a weapon, however, he did have a baton in his pocket for "self defense". Field sobriety tests indicated that Jose was under the influence of alcohol, and he was placed under arrest before the tests were completed due to his inability to complete them. Jose became resistive and tensed up his arms as officers arrested him. He continually made homophobic remarks towards officers and threatened the arresting officer. His car was searched, officers located several empty cans of Mike's Hard Lemonade as well as an unopened container of Modelo beer. Jose was taken to the hospital where an evidentiary blood draw took place. At the hospital, Jose continued to be uncooperative and made derogatory statements to hospital staff and officers. He also stated that he quote "wanted to go three rounds" with the arresting officer. Jose was issued citations for OWI, second offense, operating a motor vehicle without insurance, keep open intoxicants in motor vehicle, and operating left of center. He was charged with OWI, operating with prohibited alcohol concentration, resisting or obstructing an officer, bail jumping, operating while revoked, keeping open intoxicants in vehicle, operating a motor vehicle without insurance and operating left of center. He was found guilty of OWI and sentenced to 8 months in local jail, all other charges were dismissed. Note: according to court records, this was his third OWI, however according to the incident report it was his second. ❓Inquiries: LensOfLaw@gmail.com ☕Support Me: https://www.buymeacoffee.com/lensoflaw 🔗My Links: https://lensoflaw.com The content we highlight is designed to provide a real-life glimpse into the encounters of law enforcement, not to demean or belittle those featured.
