SARATOGA SPRINGS, NY - On May 21st, 2020 at 12:21AM, Saratoga Springs Police responded to a report of a vehicle crash within city limits. Upon arrival, a sergeant noticed a man walking down the road who identified himself as the driver. After being questioned by a secondary officer, the suspect claimed that he was delivering food before heading home. The suspect further claimed to live approximately three miles away from the scene of the accident. To avoid being hit by any debris, the sergeant ordered the suspect to move away from the car and to the front of his vehicle. The suspect claimed that he was not injured in the accident and had drank three "pretty strong" cocktails earlier in the night. The suspect then agreed to perform a standardized field sobriety test (SFST). During the horizontal gaze nystagmus test, the officer observed the suspect to have lack of smooth pursuit in both eyes, distinct and sustained nystagmus at maximum deviation in both eyes, as well as having the onset of nystagmus prior to 45 degress in both eyes. For the walk-and-turn test, the suspect claimed that he could perform the test despite having a sore ankle unrelated to the accident. The suspect was unable to keep his balance, stopped walking to ask how many steps to take, missed multiple heel to toe steps, raised his arms, took the wrong number of steps, and failed to turn properly. During the one leg stand test, the suspect swayed while balancing, used his arms for balance, hopped, and put his foot down. At the conclusion of the SFST, the suspect submitted a preliminary breath alcohol sample which yielded a result of .173%. This is above two times the legal limit of .08% breath alcohol content to drive in the State of New York. The suspect was then arrested for driving while intoxicated (DWI) and taken to the Saratoga Springs Police Department for further processing.
