MUNDELEIN, IL - At 5:20PM on January 13th, 2020, a Mundelein Police Officer spotted a man whose vehicle was stuck on the train tracks after accidentally missing the turn into a tax services company. The responding officers tried to recover the vehicle by pushing the car as the driver of the vehicle attempted to drive in reverse. When asked how much the suspect had to drink, the suspect responded that he had not had any alcoholic beverages, however, the odor of alcohol was detected on his breath by more than one officer. As the investigation continued, an officer acted as an interpreter to ensure that the suspect understood what was being said to him. The suspect admitted to drinking at midnight the day prior, but claimed his wife was driving at the time. Shortly after, a responding officer performed a field sobriety test on the suspect. During the horizontal gaze test, the suspect had difficulty following the officer's finger smoothly and demonstrated a jerking motion in his eyes at maximum deviation. The officer asked again when the last time the suspect had drank and the suspect reaffirmed that the last time he consumed an alcoholic beverage was the night prior. The suspect stated that he may have difficulties walking, but agreed that he would be able to perform the walk-and-turn test. The suspect did not touch heel-to-toes on several steps, did not straighten his feet, did not count his steps aloud as instructed and walked only seven steps after the turn. During the one leg stand test, the suspect initially did not count while standing on one leg as instructed. On the second attempt, the suspect counted, but lost his balance several times. The suspect then complained of pain in the leg on which he was standing as the reason he could not balance beyond 10 seconds. Following the one-legged balance test, the suspect blew into a preliminary breath test device and recorded a .204% BrAC. Following this result, the suspect was arrested and brought to the station to blow into a breathalyzer machine. After several failed attempts, the suspect was informed that he would lose his license for one year due to the official result being recorded as a refusal. Upon hearing this, the suspect made a further three attempts on the breathalyzer with his final attempt being successful. The suspect blew a .252% BrAC which is over three times the legal limit to operate a motor vehicle in the State of Illinois.
