On October 4, 2024, Las Cruces Police Sergeant Chavez stopped a vehicle that allegedly had illegible license plates. The police report indicates that Sgt. Chavez could smell alcohol coming from inside the vehicle. He asked the 26-year-old driver to step out of the vehicle. She initially denied consuming alcohol and stated that she had been asleep earlier in the evening. Sgt. Chavez's report notes that her makeup was not smeared and her hair was not messed up. The woman was asked to perform standardized field sobriety tests and was subsequently arrested for Driving While Intoxicated (DWI). She was read the New Mexico Implied Consent Act and she indicated that she would provide a breath sample. This elevated her charge to an Aggravated DWI. She was transported to the Las Cruces police station and she was ultimately taken to the Dona Ana County Detention Center to await her initial appearance. All suspects are presumed to be innocent until proven guilty in a court of law.
