On May 15, 2022, at approximately twelve-thirty-two AM, Officers Johnson and Henry of the Houston Police Department were dispatched to an assault call in Harris County. Upon arrival, they met with the complainant, who reported that she had been assaulted by her boyfriend, the defendant. The complainant stated that she and the defendant had been in a relationship for three years and that she was currently fifteen weeks pregnant with his child. She also reported that the defendant and her family did not get along. According to the complainant, the defendant became upset with her after she bought her mother a gift that he felt was too expensive. He then left the location but returned a short time later, and the argument continued, along with verbal insults. The complainant stated that the defendant grabbed her with both hands, threw her against the wall, and punched her two times with a closed fist in the back of the head behind her left ear. The defendant then threw her to the floor and punched her multiple times in the same spot. The complainant pushed the defendant back as she was getting up from the floor, and he continued to punch her. She informed the defendant that she was three months pregnant with his child, and he responded by telling her that if he got caught by the police, they would have to let him out eventually. Officers observed a hematoma located behind the complainant's left ear in her hairline, consistent with the assault described. The defendant admitted to officers that he and the complainant had been in a verbal argument over the house not being cleaned. The defendant was arrested and transported to Harris County Jail for processing. 44-year-old Deivy Vilchez was arrested on one felony charge of assault on a pregnant person. If convicted, he could face anywhere from 2 to 10 years in prison. The victim was taken to a local hospital and treated for minor injuries.
