On March 6, 2024 around 3:34 PM, Officer Gilbert Barberan, Corporal Ryan Steckel, and Corporal Ryan Fandel with the Chester Township Police Department responded to the scene of a motor vehicle accident involving a 2021 Cadillac Escalade that had crashed into a utility pole on Oakdale Road. They arrived on scene and observed that the Cadillac had crashed into the pole on the passenger side. The passenger side had sustained severe damages and there was airbag deployment inside the vehicle. Officer Barberan first made contact with the driver, who was identified as Jordyn. She told Officer Barberan that she was headed to pick up her child from school, and that she crashed when she dropped her phone and tried to retrieve it. When he asked for her driver’s license, she initially handed him a credit card. Corporal Fandel also spoke with 2 witnesses in the car behind her, and they recorded a video of her driving erratically and crossing over into the oncoming lane before crashing into the pole. While Officer Barberan did not detect the odor of alcohol, he observed other indicators of impairment when he was speaking with her. Since she had been involved in a car crash with airbag deployment, first responders were called to the scene. Jordyn declined further medical attention, and the officers proceeded with the administration of field sobriety exercises. Corporal Fandel started with the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test, and it was administered by Officer Barberan. During the Walk and Turn test, Jordyn did not touch heel-to-toe on each step and turned improperly. The final exercise was the One Leg Stand test. During the One Leg Stand test, Jordyn failed to raise her foot in the proper fashion. Based on the motor vehicle crash and her inability to satisfactorily complete the field sobriety exercises, Jordyn was placed under arrest. Officer Barberan transported her to the Chester Township Police Department for further processing. At the station, the Standard Statement for Motor Vehicle Operators was read to her, and she agreed to provide breath samples for testing. Her Alcotest results indicated a BAC level of 0.00%. While her BAC level was at 0.00%, they still suspected she was impaired so a DRE was called to the station. Sergeant Ambrosi with the Mendham Township Police Department responded to conduct the DRE evaluation, and Jordyn also provided a urine sample. Her urine test results would later indicate the presence of Alprazolam. Jordyn was later released pending her court appearance. Officer Barberan issued her the following summonses: Operating under the influence, reckless driving, failure to keep right, traffic on marked lanes, and failure to keep right Court records indicate that on October 3, 2024, Jordyn pleaded guilty to operating under the influence. As a result of her guilty plea, Jordyn was required to use an ignition interlock device for 3 months, spend 12 hours at an intoxicated driver resource center, and pay a total of $640 in fines. The other citations were dismissed as part of a plea agreement. ------------------------------------------ Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
