Around 2:14 AM on July 30, 2023, Officer Eric Steele with the Morristown Police Department responded to a report of a pedestrian being struck by a vehicle on Liberty Street near the intersection with Hazel Street. He made contact with the 20-year-old woman who had been struck, and she had visible scrapes on her and indicated to others that her whole body was in pain. Officer Sean Grawehr arrived on scene shortly afterwards and observed that a 2017 Honda Civic was in the middle of the road. He made contact with 22-year-old Jessica Andresflores, who admitted to striking the 20-year-old woman. Witnesses indicated to Officer Grawehr that Jessica may be impaired. He also detected the odor of alcohol and observed indicators of impairment when he was interacting with Jessica. She told admitted to Officer Grawehr that she had consumed 3 drinks earlier that evening and claimed that she struck the pedestrian because she was unable to see her as she was making a turn. Based on the officers’ suspicion of impairment, Jessica was asked to perform field sobriety exercises. Officer Grawehr started by asking Jessica to count backwards from “52” to “39,” but she was unable to do so satisfactorily. The first field sobriety exercise was the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Officer Grawehr observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. The second exercise was the Walk and Turn test. During the Walk and Turn test, Jessica did not touch heel-to-toe on each step, turned improperly, and took an incorrect number of steps. The final exercise was the One Leg Stand test. During the One Leg Stand test, Jessica failed to raise her foot in the proper fashion and put her foot down before the test was complete. Based on her striking a pedestrian, the odor of alcohol, her admission to consuming alcohol, and her inability to satisfactorily complete the field sobriety exercises, Jessica was placed under arrest for DWI. After she was placed under arrest, her vehicle was impounded for a 12-hour hold according to John’s Law. The pedestrian she struck was transported to Morristown Medical Center for further evaluation. Jessica was transported by Officer Steele to the Morristown Police Department for further processing. She was read Standard Statement for Motor Vehicle Operators, and she agreed to submit breath samples. She also waived her Miranda rights and admitted to drinking at Whiskey & Virtue earlier that evening. Officer Michael Cerick administered the Alcotest machine and her Alcotest results indicated a BAC of 0.18%, which more double the legal limit of 0.08%. After they were finished processing Jessica, she was released to her father pending her court appearance after he signed the Potential Liability Warning on Jessica’s behalf. Officer Grawehr issued Jessica the following traffic citations: -Operating under the influence (39:4-50) -Failure to exercise due care for pedestrian (39:4-32G) -Failure to stop to allow pedestrian to cross marked crosswalk (39:4-36(A)(1)) -Reckless driving (39:4-96) -Failure to possess driver registration (39:3-29B) Jessica was also criminally charged with Assault by Auto (2C:12-1C(1)). Court records indicate that on October 19, 2023, Jessica was found guilty of 39:4-50 and 39:4-36(A)(1). As a result of being found guilty, Jessica had to use an ignition interlock device for 5 months, spend 12 hours at an intoxicated driver resource center, and pay a total of $966 in fines. The other 3 citations were dismissed as part of a plea agreement. The Assault by Auto charge was downgraded to Disorderly Conduct (2C:33-2A(1)) along with a $6 fine. ------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
