On September 11, 2022 at approximately 4:18 AM, Deputy Randy Miller of the Whitman County Sheriff’s Office observed a 2008 Ford Escape driving erratically and even cross the center line on SR 195 in Colfax, Washington. The driver nearly rear ended another vehicle and happened to drive over the speed limit. He proceeded to initiate a traffic stop, and the vehicle pulled over near the intersection of Wawawai Street and S Main Street in Colfax. The driver was identified as 20-year-old Greenleigh Stinson. Greenleigh told Deputy Miller that she was coming from Pullman and heading to visit her sister in Colfax. She initially denied being under the influence of alcohol. Since Deputy Miller noticed that she seemed incoherent and he detected the odor of alcohol, he proceeded to ask Greenleigh if he could check her eyes. When he initially checked her eyes, he noticed a lack of smooth pursuit in her left eye. He asked her once again whether she had consumed alcohol, and Greenleigh admitted to drinking a Budlight Seltzer approximately 2 hours prior. Based on the indicators of impairment, Deputy Miller radioed for backup units to respond and told Greenleigh that she would be afforded an opportunity to perform voluntary field sobriety exercises. Two additional deputies responded shortly thereafter and Deputy Miller began to administer the field sobriety exercises. The first exercise involved the Horizontal Gaze Nystagmus (HGN), where Deputy Miller observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees in both eyes. The second exercise was the Walk and Turn test, and Greenleigh took 9 steps forward while subsequently failing to turn around and walking backwards for the second set of 9 steps. The final exercise was the One Leg Stand test. During the One Leg Stand test, Greenleigh failed to raise her leg in the proper manner and counted to 22 during the passage of 30 seconds. Following the field sobriety exercises, Greenleigh was asked to voluntarily take a PBT test, and the results indicated a BAC of 0.125%. Based on her inability to adequately perform the field sobriety exercises and the results of her PBT test, Deputy Miller placed Greenleigh under arrest for driving under the influence. Greenleigh was subsequently transported to the Whitman County Jail, which was less than a mile away in Colfax. After Deputy Miller read her the Constitutional rights, Greenleigh waived them and agreed to answer questions. During the interview process, Greenleigh admitted to driving the vehicle under the influence. Deputy Miller read the Implied Consent Warnings to Greenleigh, and after she completed the observation period, she agreed to take a breathalyzer test. Her Alcotest results indicated a BAC of 0.111%, which was more than the legal limit of 0.08% for motorists over 21 and over 5 times the legal limit of 0.02% for motorists under 21. Following the breathalyzer test, Greenleigh was formally booked the Whitman County Jail in Colfax, Washington with a bail amount of $500. She was cited under RCW 46.61.502 for Driving under the Influence (DUI) and released with a mandatory court date after posting bail. On October 27, 2022, Greenleigh pleaded guilty to an amended charge under 46.61.5249 – Negligent Driving in The First Degree (Misdemeanor). She was sentenced to 1 day in jail (with the option to be converted to 12 hours of community service) followed by 24 months of supervised probation. She was ordered to pay a $50/month probation fee, $43 Criminal Conviction Fee, $250 Public Defender Recoupment, and a $1000 fine. ----------------------------------------------------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information).
