Around 12:42 AM on March 4, 2024, Sergeant Edward O’Donnell with the Lindenwold Police Department observed a black 2011 Hyundan Sonata stopped in the middle of Gibbsboro Road near the intersection with White Horse Pike in the neighboring town of Clementon. He initiated a traffic stop and made contact with the driver, who was eventually identified as Jamira Marsh. The driver claimed that the ignition was not starting, even though the battery was on. He instructed her to put the vehicle in park, and then she was able to start the vehicle. As he was speaking with Jamira, he detected the odor of alcohol and observed other indicators of impairment. Other officers arrived on scene to assist shortly afterwards, and Patrolman Thomas Mallon started a DWI investigation. Based on their suspicion of impairment, Jamira was eventually asked to exit the vehicle and perform field sobriety exercises. Patrolman Mallon started with the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test. During the Walk and Turn test, Jamira failed to touch heel-to-toe on each step and took an incorrect number of steps in each direction. The final exercise was the One Leg Stand test, but Jamira tried completing the Walk and Turn test instead. Based on the odor of alcohol, her indicators of impairment, and her inability to satisfactorily complete the field sobriety exercises, Jamira was placed under arrest for DWI. A search of her vehicle incident to arrest yielded an open 375 ml bottle of Hennessy. Her vehicle was impounded for a 12-hour hold according to John’s Law. She was then transported to the Lindenwold Police Department for further processing. At the station, the Standard Statement for Motor Vehicle Operators was read to her, but she refused to submit breath samples. After they finished processing Jamira, she was released to a sober adult pending her court appearance after she signed the Potential Liability Warning on Jamira’s behalf. Sergeant O'Donnell issued Jamira the following tickets: -Operating under the influence (39:4-50) -Consent to take samples of breath (39:4-50.2) Court records indicate that on May 1, 2024, Jamira’s DWI citation was dismissed, but she was found guilty of consent to take samples of breath. As a result of her conviction, Jamira had to spend 48 hours at an intoxicated driver resource center and pay a total of $740 in fines. Jamira has previously been arrested for DWI in Stratford, New Jersey on May 8, 2021. ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2001, c. 404). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
