Around 2:40 AM on October 29, 2023, Patrolman Tyler Mania with the Delran Township Police Department observed a blue 2011 Hyundai Genesis fail to obey a traffic signal on Haines Mill Road. He began following the vehicle and initiated a traffic stop on Route 130 near Creek Road. Patrolman Erdem Ucak arrived on scene shortly afterwards and both officers made contact with the driver, who was later identified as Madeline. As he was speaking with Madeline, he detected the odor of alcohol and observed other indicators of impairment. He asked Madeline how much she had to drink, and she admitted to having 1 drink earlier that evening at a Halloween party in Philadelphia. Madeline also told the officer that she had previously been arrested for driving under the influence. Based on his suspicion of impairment, Madeline was asked to exit the vehicle and perform field sobriety exercises after. The first field sobriety was the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test. During the Walk and Turn test, Madeline failed to touch heel-to-toe on each step and turned improperly. The last exercise was the One Leg Stand test, and Madeline failed to raise her foot in the proper fashion during this test. Based on her traffic infraction, the odor of alcohol, her admission to consuming alcohol, the open container inside her vehicle, and her inability to satisfactorily complete the field sobriety exercises, Patrolman Malia placed Madeline under arrest for driving under the influence. A search of her vehicle incident to arrest yielded an open container. Her vehicle was later impounded for a 12-hour hold according to John’s Law. Patrolman Malia transported Madeline to the Delran Township Police Department for further processing. Madeline was read the Standard Statement for Motor Vehicle Operators at the station, and she agreed to submit breath samples. Her Alcotest results indicated a BAC level of 0.13%, which was more than the legal limit of 0.08%. Madeline was eventually released to a sober adult pending her court appearance after she signed the Potential Liability Warning form on Madeline’s behalf. Patrolman Malia issued Madeline the following citations: Operating under the influence, reckless driving, careless driving, failure to obey traffic control device, and open container Court records indicate that on July 31, 2024, Madeline’s DWI citation was dismissed according to a plea agreement. However she was found guilty of reckless driving. As a result, she had to use an ignition interlock device for 2 months and pay a total of $440 in fines. The other 3 citations were dismissed as part of a plea agreement. Madeline had previously been arrested for driving under the influence in Lumberton Township, New Jersey on December 10, 2022. ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. South Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
