According to the officer’s statement, they were in federal waters at the time of the incident. In federal waters bluefish have no minimum size limit, but they do have a 3 per person bag limit. In state waters, bluefish must be at least 12” measured to the fork and have a 3 per person bag limit. The mutton snapper size limit change went into effect January 1, 2017. Mutton snapper currently have a minimum total length requirement of 18” with a 5 per person bag limit. The bag limit is part of a 10 snapper per person aggregate bag limit. Hawley’s charges are quite interesting. He was charged with possession of undersized bluefish, despite being in federal waters where there is no minimum length. He was over the bag limit but did not receive a charge for that. He was also charged with possession of undersize mutton snapper and issued a citation for the fire extinguisher. He was adjudicated guilty on both misdemeanor charges and we are currently awaiting the court documents from the county for sentencing information.
