Around 6:16 PM on March 3, 2024, officers with the Wall Township Police Department noticed that a female was asleep behind the wheel of a black 2017 Mazda inside the parking lot of their station. They awakened her, and she was eventually identified as 20-year-old Paige Finnegan. As they were speaking with Paige, they detected the odor of alcohol inside the vehicle while noticing the presence of an open container of vodka. Based on their suspicion of impairment, the female was asked to exit the vehicle as they initiated a DWI investigation. Paige admitted to consuming alcohol earlier that evening, and told the officers that she was looking for a safe place where she could sleep inside her car. At this point, the officers asked her to perform field sobriety exercises. The first exercise was the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test. During the Walk and Turn test, Paige failed to touch heel-to-toe on each step and initially failed to turn. The final exercise was the One Leg Stand test, and Paige failed to raise her foot in the proper fashion while putting her foot down before the test was complete. Based on her falling asleep in her car, the odor of alcohol, her admission to consuming alcohol earlier that evening, and her inability to satisfactorily complete the field sobriety exercises, Paige was placed under arrest for DWI. Her vehicle was impounded for a 12-hour hold according to John’s Law. The officers escorted her on foot into the Wall Township Police Department for further processing. At the station, the Standard Statement for Motor Vehicle Operators was read to her, but she refused to submit breath samples. After they finished processing Paige, she was released to her father pending her court appearance after he signed the Potential Liability Warning on Paige’s behalf. Patrolman Martin issued Paige the following traffic tickets: -Operating under the influence (39:4-50) -Operating under the influence underage (39:4-50.14) -Reckless driving (39:4-96) -Refusal to submit to chemical test (39:4-50.4A) -Consent to take samples of breath (39:4-50.2) ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). This is similar to other law enforcement channels on YouTube. All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq. (P.L. 2001, c. 404). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. Central Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
