Around 11:24 PM on June 12, 2026, Patrolman Peter Muscarella with the Island Heights Police Department observed a white 2022 Hyundai Tucson fail to stop at stop sign at the intersection of Lake Avenue and Central Avenue. The driver turned right onto Central Avenue and he observed the driver going 48 MPH in a 30 MPH zone while headed northbound. He eventually clocked the vehicle at 55 MPH in a 30 MPH zone. The driver turned onto Route 37 and continued eastbound, and Patrolman Muscarella eventually activated his emergency lights to initiate a traffic stop. After he activated his emergency lights, the driver pulled over on Bash Road in the neighboring town of Toms River. Patrolman Muscarella exited his patrol car to make contact with the driver, who was eventually identified as Melanie Gallego. As he was speaking with Melanie, he detected the odor of alcohol and observed other indicators of impairment. She told Patrolman Muscarella that she had consumed 1 drink at a friend’s house earlier that evening. She also mentioned multiple times that her brother was a police officer who worked for the Port Authority Police Department. Based on his suspicion of impairment, Patrolman Muscarella eventually asked Melanie to exit the vehicle and perform field sobriety exercises after Officer Officer Sean McNicholas with the Toms River Police Department arrived on scene to assist. Her poor performance on the field sobriety exercises confirmed the officers’ suspicions of impairment. Based on her erratic driving, the odor of alcohol, and her inability to satisfactorily perform the field sobriety exercises, Melanie was placed under arrest for driving under the influence. As she was being placed under arrest, she continued to tense up her body and tried pulling her arms away from the officers. She was eventually placed in the patrol car after being handcuffed. Afterwards, her vehicle was impounded for a mandatory 12-hour hold under John’s Law. Patrolman Muscarella transported Melanie to the Island Heights Police Department for further processing. At the station, the Standard Statement for Motor Vehicle Operators was read to Melanie, but she refused to submit breath samples. Her Alcotest results indicated a BAC level of 0.19%, which was more than double the legal limit of 0.08%. After they finished processing Melanie, she was eventually released to her boyfriend pending her court appearance after he signed the Potential Liability Warning form on Melanie’s behalf. Melanie was issued the following traffic citations: -Operating under the influence (39:4-50) -Refusal to submit to chemical test (39:4-50.4A) -Consent to take samples of breath (39:4-50.2) -Reckless driving (39:4-96) -Careless driving (39:4-97) -Speeding (39:4-98.19) -Disregarding a stop sign (39:4-144) -Failure to possess a driver’s license (39:3-29A) -Delaying traffic (39:4-56) Melanie was also criminally charged with resisting arrest (2C:29-2A(1)). As of September 23, 2026, this particular case is still pending before the Island Heights Municipal Court. Melanie has previously been arrested on charges of simple assault (2C:12-1A(1)) in Toms River, New Jersey on November 8, 2025. ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
