Around 12:01 AM on September 21, 2024, Patrolman Sean Bryant with the Somerdale Police Department observed the driver of a 2015 Jeep driving at a high rate of speed on Warwick Road in the vicinity of Preston Avenue. The vehicle also appeared to be tailgating the vehicle in front, but she was actually following her father’s vehicle as they were headed home. He began pursuing the vehicle and initiated a traffic stop at Warwick Road and Elenor Avenue in the neighboring town of Stratford. The driver pulled over and the vehicle she was following stopped in front of that car. Patrolman Bryant contact with the driver, who was identified as 20-year-old Leila. Leila told Patrolman Bryant that she was coming from a wedding and that she was headed home. As he was speaking with Leila, he detected the odor of alcohol. Based on his suspicion of impairment, Leila was asked to exit the vehicle and perform field sobriety exercises. The first exercise was the Horizontal Gaze Nystagmus (HGN) test, but she did not cooperate so the test could not be completed. The second exercise was the Walk and Turn test. During the Walk and Turn test, Leila failed to touch heel-to-toe on each step, took an incorrect number of steps, and turned improperly. The final exercise was the One Leg Stand test, and Leila failed to raise her foot in the proper fashion while placing her foot down before the test was complete. Patrolman Bryant asked Leila how much she had to drink, and she admitted to consuming 2 drinks earlier that evening. Based on her erratic driving, the odor of alcohol, her admission to consuming alcohol, and her inability to adequately complete the field sobriety exercises, Patrolman Bryant placed Leila under arrest for driving under the influence. The vehicle that she had been driving was impounded for a mandatory 12-hour hold under John’s Law. Instead of the Somerdale Police Department, Leila was transported to the Stratford Police Department for further processing. Before transporting her to the Stratford Police Department, Patrolman Bryant read Leila the Standard Statement for Motor Vehicle Operators. Leila agreed to submit breath samples for testing. Her Alcotest results indicated a BAC of 0.15%, which was almost double the legal limit of 0.08% for drivers over 21 and 15 times the legal limit of 0.01% for drivers under 21. After Leila was processed, Patrolman Bryant gave Leila a ride home and released her to her mother after she signed the Potential Liability Warning form on Leila’s behalf. Leila was issued the following summonses: Operating under the influence, reckless driving, careless driving, and failure to maintain lane ------------------------------------------------ Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
