Around 2:21 AM on August 11, 2025, Corporal Brian Matthews with the Roselle Park Police Department observed a silver 2020 Toyota Yaris being driven without headlights while headed westbound on East Westfield Avenue. The driver then failed to stop for the right light at the intersection of East Westfield Avenue and Linden Road. The driver continued southbound on Linden Road into the neighboring town of Roselle, and once again failed to stop for the red light at Linden Road and East 2nd Avenue. He eventually activated his emergency lights to initiate a traffic stop, and the driver pulled over the vicinity of Linden Road and East 3rd Avenue. He exited his patrol car and made contact with the driver, who was identified as Enney Pena-Beltran. As he was speaking with Enney, he detected the odor of alcohol and observed other indicators of impairment. Enney told the officer that she could not speak English, and repeatedly frustrated him as he attempted to communicate with her. She claimed that she was coming from 2 different places where she happens to work and that she was heading home. One of those places happened to be Breathless, which is a gentlemen's club in Rahway, New Jersey. As he was speaking with her, Corporal Matthews observed an open beer bottle inside Enney's vehicle. Since there was a language barrier, Officer Serrano with the nearby Linden Police Department was dispatched to the scene to assist with translation. Based on Corporal Matthews' suspicion of impairment, Enney was eventually asked to exit the vehicle and perform field sobriety exercises after Officer Serrano arrived on scene to assist. Enney’s poor performance on the field sobriety exercises confirmed the officers’ suspicion of impairment. Based on her traffic infractions, the odor of alcohol, the open beer bottle inside her vehicle, and her inability to satisfactorily complete the field sobriety exercises, Corporal Matthews placed Enney under arrest for driving under the influence. Her vehicle was impounded for a mandatory 12-hour hold under John’s Law. Enney was transported to the Roselle Park Police Department (RUPD) for further processing. At the Roselle Park Police Department, Enney was read the Standard Statement for Motor Vehicle Operators, and she initially agreed to submit breath samples. However, she failed to submit 2 valid breath samples, so she was eventually charged with a refusal. After the officers finished processing Enney, she was eventually released to Isabel Guerrero pending her court appearance after she signed the Potential Liability Warning form on Enney’s behalf. Corporal Matthews issued Enney the following traffic citations: -Operating under the influence (39:4-50) -Refusal to submit to chemical test (39:4-50.4A) -Careless driving (39:4-97) -Obstructing passage of other vehicles (39:4-67) -Failure to use lighted lamps when required (39:3-47A) -Open container (39:4-51B) On November 19, 2025, Enney was found guilty of operating under the influence and obstructing passage of other vehicles, while the other 4 citations were dismissed as part of a plea agreement. As a result of her convictions, Enney had to use an ignition interlock device for 3 months and spend 12 hours at an intoxicated driver resource center. Enney also had to pay a total of $1,030 in fines. ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
