TOWN OF BELOIT, WI - On December 31st, 2020 at 6:53PM, an officer with the Town of Beloit Police Department observed a vehicle traveling above the speed limit northbound on S. Riverside Dr. The officer turned his vehicle around and stopped the suspect approximately 30 seconds after activating his emergency lights. The officer then approached the vehicle on the passenger side to speak with the suspect. The officer asked why the suspect was not wearing his seatbelt to which the suspect replied, "Why not?" The suspect then told the officer that he assumed he was going to be taken out of the vehicle. The officer observed the suspect to have several marks and bruises on his face along with red and glassy eyes. The officer further detected a moderate odor of an intoxicating beverage coming from the passenger compartment of the vehicle. The suspect claimed that he had just gotten into a fight with his brother and had "just a beer" when asked how much he had drank in the night. Eventually, the suspect was asked to step out of the vehicle to which he complied. The suspect was unsteady on his feet and the officer detected a strong odor of intoxicating beverages coming from his breath and body. After denying medical care, the suspect began to perform a field sobriety test. During the horizontal gaze nystagmus test, the suspect had a lack of smooth pursuit, distinct nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees in both eyes. The suspect's demeanor was observed as agitated, loud, and emotional by the officer. After the officer spoke with the sergeant on scene and decided to no longer continue the field sobriety test, he asked the suspect if he wanted to provide a preliminary breath sample. After the suspect refused to provide a breath sample, he was arrested and charged with speeding and operating while intoxicated (OWI).
