Watch this police interrogation with intense raw interrogation from the interrogation room as police conduct a full interrogation of a suspect. This raw interrogation footage captures every moment of the suspect interview, complete with deception detection techniques, and criminal psychology in true JCS style interrogation. The Background Dystynee Avery, 19, had recently moved from Colorado to Moorhead, Minnesota, and was staying with Ethan Martin Broad, then 27, at an apartment at 1310 28th Ave. S. Avery’s mother, Doreen Avery, described Broad as a friend who appeared to care about her daughter. Avery’s sister later said Broad had offered to look after her when she was in a vulnerable situation. Andrea Catherine Payne also lived in the apartment. David Marvin Erno and Brandon Everett Leroy Erbstoesser were associates who later helped after the killing. In his January 2021 guilty plea, Broad said he was angry at Avery and claimed she swung a pipe at him. No other motive was established in the complaint. The Crime The killing took place on April 3, 2020, inside the Moorhead apartment. Broad pleaded guilty to hitting Avery over the head with a pipe and cutting her throat. He said this happened during an argument. He then dragged her body to a garage, used saws to dismember her, placed the remains in garbage bags, and put the bags in a nearby dumpster. Payne told investigators she was in the apartment, heard an argument and several loud strikes, and that Broad then told her to leave. She did not check on Avery. Remains were recovered on April 22, 2020, at the Clay County landfill near Hawley, Minnesota, after the dumpster contents were taken there. The Investigation Avery was reported missing in early April 2020 after her mother had not heard from her. Broad was among those who reported her missing and said she had left on April 4 with her belongings. Broad first told police that someone else had hit Avery with a lead pipe and cut her throat, and that he only helped with the dismemberment. After surveillance video showed him leaving the garage alone with blue bins, he admitted he killed and dismembered her alone, still calling it self-defense. Two witnesses told police Broad had admitted the killing and dismemberment to them. A search of the apartment and garage found a saw with what appeared to be blood and tissue, blue bins with blood, and areas that appeared to have been cleaned of blood. Payne later returned with Erno. Erno admitted wiping identifying information from Avery’s computer. Both told police stories that Avery might have left for Colorado or Texas, despite knowing she was dead. Erbstoesser spoke with Broad by phone, told him to report Avery missing, and later went to the apartment to help clean and remove her property, according to the complaint. Conviction and Sentencing Broad was charged in Clay County with second-degree murder. He pleaded guilty in January 2021 to second-degree murder with intent. A second-degree murder count alleging the killing was without intent was dismissed. A later request to withdraw the plea was denied. On May 21, 2021, Judge Tammy Merkins sentenced Broad to 367 months (30½ years), the statutory maximum on that plea, with credit for 400 days in jail. Under the plea terms he could serve about two-thirds of that time if he did not violate conditions. He showed little emotion and declined to speak at sentencing. Payne pleaded guilty to one felony count of being an accomplice after the fact. She was sentenced to time served (about 378 days) and five years of supervised probation. Erno pleaded guilty to aiding after the fact and received time served and probation. Erbstoesser entered an Alford plea to aiding an offender. On March 28, 2022, Judge Michelle Lawson sentenced him to time served (credit for 407 days) and up to five years of supervised probation, plus fines and fees. He was the last of the four defendants sentenced.
