On March 24, 2024 around 12:22 AM, Patrolman Evan Sicknick, Patrolman Thomas Micklos, Patrolman Collin Robertazzi, and Sergeant Sean Varady with the Berkeley Township Police Department were dispatched to the scene of a motor vehicle crash involving a damaged retaining wall in front of the Timothy E. Ryan Home for Funerals. Patrolman Sicknick made contact with the 25-year-old driver of the 2019 Honda that had struck the retaining wall, and she was identified as Ana. As he spoke with Ana and watched her climb into the ambulance rig, he observed indicators of impairment. Ana told them that she was headed home from MJ’s, a popular bar in Bayville, and admitted to consuming alcohol before operating a motor vehicle. Ana was evaluated by first responders, and she told them that she did not wish to go to the hospital. After she declined further medical attention, Sergeant Varady instructed Patrolman Sicknick to administer field sobriety exercises after observing indicators of impairment in her eyes. Patrolman Sicknick started with the Walk and Turn test. During the Walk and Turn test, Ana failed to touch heel-to-toe on each step while taking an incorrect number of steps. The final exercise was the One Leg Stand test, and Ana failed to raise her foot in the proper fashion while nearly falling over. Sergeant Varady decided that they would terminate the tests for her safety. Based on the traffic accident, her indicators of impairment, and her inability to adequately perform the field sobriety exercises, Ana was placed under arrest for driving under the influence. Patrolman Sicknick transported her to the Berkeley Township Police Department for further processing. Patrolman Sicknick read her the Standard Statement for Motor Vehicle Operators, and she initially agreed to submit breath samples for testing. Ana also vomited on the floor and the 20-minute observation period had to be restarted numerous times because she kept spitting. Eventually, Ana refused to submit breath samples, and she was charged for her refusal. After the officers finished processing her, she was released to her father pending her court appearance after he signed the Potential Liability Warning form on her behalf. Patrolman Sicknick issued her the following traffic tickets: Operating under the influence, refusal to submit to breath testing, consent to take samples of breath, reckless driving, and careless driving ------------------------------------------ Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). Our content is educational and in compliance with YouTube's Fair Use Policy because we edit several long clips into a concise story. This is similar to other law enforcement channels on YouTube. All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq. (P.L. 2001, c. 404). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
