A man is suing Ohio State Trooper Jarid Fitzpatrick in Federal Court after he was stopped in March of 2020 for failing to move over to the second lane when passing by another Trooper conducting a traffic stop. Dashcam video shows that Aaron Weisman was traveling in the first lane when he passed the troopers and couldn’t move over because there was a vehicle next to him in the second lane. He claims the stop left him with physical and mental scars. It was all caught on Trooper Fitzpatricks dashcam. When the Trooper approached the car, Weisman asked him to please put on a mask. The interaction quickly escalated after that. Fitzpatrick ordered Weisman to “get out of the car”. He threatened to break the window if he didn’t. Weisman got out and walked towards the police cruiser as instructed with his hands up. Fitzpatrick then snatches Weisman’s phone out of his hand and pushed him onto the hood and handcuffed him. Weisman said he felt assaulted and argues the force was excessive. He is overheard saying “Woah, sir, please get your supervisor here.” The Ohio Dept of Public Safety reviewed the stop. Two weeks after the stop, Trooper Fitzpatrick went through 8 hours of training including use of force, de-escalation, and professionalism. Fitzpatrick was ticketed in December of 2021 after he rear-ended a tractor trailer making headline news. According to Fitzpatrick’s personnel file, in just under four years on the job, he received one written reprimand, 2 suspensions, and issued informal counseling. His supervisor said his concern was why would Fitzpatrick order Weisman out of his car when he already had his license and registration. Fitzpatrick was suspended for five days in January of 2020. The Weisman stop was combined with two other incidents involving Fitzpatrick, including recklessly driving at speeds of nearly 145 MPH in September of 2020, and using improper techniques during a pursuit and crash that august. One month before the Weisman stop, Fitzpatrick got a one-day suspension for taunting and using profanity with a suspect he had arrested. His Lieutenant said then that our biggest concern was just Fitzpatrick’s attitude and his language. 5-0 PATROL provides unbiased and authentic footage of incidents captured on body cams.
