On February 22, 2024 around 6:29 PM, Patrolman Skylar Wintemberg with the Boonton Township Police Department was dispatched to the scene of a rollover crash on Hillcrest Road. Patrolman Wintemberg immediately made contact with the occupant of the 2023 Audi Q5 that had rolled over and assisted her as she slowly exited the vehicle. As she was exiting the vehicle, he detected the odor of alcohol and observed other indicators of impairment. The driver, later identified as Natalie, told the officers that she was headed to pick up her child. Sergeant Christopher Chicoris arrived on scene shortly afterwards as Patrolman Wintemberg was assisting her in exiting the vehicle. She initially claimed that the rollover crash occurred when she swerved to avoid 2 deer that ran in front of her vehicle. When Natalie was asked if she had anything to drink, she denied consuming any alcohol. Based on her injuries, Patrolman Wintemberg escorted her to the ambulance rig to be evaluated by first responders. After she was evaluated, she refused further medical attention and declined transport to the hospital. After the first responders evaluated her, the officers began their DWI investigation and asked her to perform field sobriety exercises. Patrolman Wintemberg started with the Walk and Turn test. During the Walk and Turn test, Natalie did not touch heel-to toe on each step, turned improperly, and took an incorrect number of steps. The second exercise was the One Leg Stand test. During the One Leg Stand test, Natalie failed to raise her foot in the proper fashion, did not count in the correct sequence, and put her foot down before the test was complete. The final exercise was the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Patrolman Wintemberg observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. Based on the motor vehicle accident, the odor of alcohol, and her inability to perform the field sobriety exercises satisfactorily, Natalie was placed under arrest for operating under the influence. Her vehicle was impounded by Corigliano Towing for a mandatory 12-hour hold under John’s Law. Patrolman Wintemberg placed her in handcuffs and transported her to the Boonton Township Police Department for further processing. At the Boonton Township Police Department, the Standard Statement for Motor Vehicle Operators was read to her and she agreed to submit breath samples for testing. Her Alcotest results indicated a BAC level of 0.19%, which was more than double the legal limit of 0.08%. Once they finished processing her, Natalie was released to her husband pending her court appearance after he signed the Potential Liability Warning form on her behalf. Patrolman Wintemberg issued her summonses for operating under the influence, reckless driving, careless driving, and traffic on marked lanes Natalie had previously been arrested for DWI in Fairfield, New Jersey on March 2, 2022. Court records for the DWI case in Boonton Township indicate that on May 8, 2024, Natalie was found guilty of operating under the influence. As a result of being found guilty, Natalie’s license was revoked for 1 year, she had to use an ignition interlock device for 2 years, and she had to spend 2 days at an intoxicated driver resource center. She also had to pay a total of $890 in fines. The other citations were dismissed as part of a plea agreement. ------------------------------------------ Please LIKE, SUBSCRIBE, and consider supporting this channel. (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
