On October 2, 2022 at approximately 1:30 AM, Deputy Christopher Olin of the Whitman County Sheriff’s Office observed a 2004 Ford Expedition driving erratically on NE B Street in Pullman, Washington. The driver was weaving and crossed the center line on multiple occasions. He proceeded to initiate a traffic stop and the vehicle pulled into a McDonald’s parking lot. The driver was identified as 22-year-old Megan Milan. Megan told Deputy Olin that her and her passenger had been at The Coug in Pullman and they were heading back home. She initially denied being under the influence of alcohol. Since Deputy Olin noticed that she seemed incoherent and he detected the odor of alcohol, he proceeded to ask Megan once again how much she had been drinking. Megan eventually admitted to consuming alcohol in the hours prior. Based on the indicators of impairment, Deputy Olin told Megan that she would be afforded an opportunity to perform voluntary field sobriety exercises. The first exercise involved the Horizontal Gaze Nystagmus (HGN), where Deputy Olin observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees in both eyes. The second exercise was the Walk and Turn test, and Megan was unable to walk in a straight line or turn as instructed. The final exercise was the One Leg Stand test. During the One Leg Stand test, Megan did not raise her foot in the proper fashion and while continuing to sway her arms for balance. Following the field sobriety exercises, Megan was asked to voluntarily take a PBT test, and the results indicated a BAC of 0.111%. Based on her inability to adequately perform the field sobriety exercises and the results of her PBT test, Deputy Olin placed Megan under arrest for driving under the influence. Megan was subsequently transported to the Pullman Police Department nearby for initial processing. Her passenger was instructed to call a ride home because it would not be safe for her to drive either. After Deputy Olin read her the Constitutional rights, Megan waived them and agreed to answer questions. During the interview process, Megan admitted to driving the vehicle under the influence. Deputy Olin read the Implied Consent Warnings to Megan, and after she completed the observation period, she agreed to take a breathalyzer test. Her Alcotest results indicated a BAC of 0.097%, which was more than the legal limit of 0.08% for motorists over 21. After the breathalyzer test, Megan was transported to the Whitman County Jail in Colfax, Washington for further processing. She was cited under RCW 46.61.502 for Driving under the Influence (DUI) and released with a mandatory court date after posting bail of $500. On January 27, 2023, Megan pleaded guilty to an amended charge under 46.61.5249 – Negligent Driving in The First Degree (Misdemeanor). She was sentenced to 12 months of supervised probation and ordered to pay a $300 probation fee along with a $43 Criminal Conviction Fee. ----------------------------------------------------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information).
