Around 12:42 AM on August 23, 2024, Officer Edwin Rosario with the Orlando Police Department observed a Honda Civic fail to signal before turning left from Gore Street onto Division Avenue. He activated his emergency lights to initiate a traffic stop, and the driver pulled over in the vicinity of Division Avenue and Anderson after swerving. He made contact with the driver, who was identified as 25-year-old Benita Feliciano. As he was speaking with Benita and her passenger, he detected the odor of burnt cannabis. Benita told Officer Rosario that they were heading home from a friend’s house, but she was unable to explain why she was wearing a wristband. She denied smoking recently, but admitted to consuming alcohol earlier in the afternoon. She and her friend continued to offer contradictory accounts of where they were coming from and where they were headed. After additional officers arrived on scene, Benita was asked to exit the vehicle and perform field sobriety exercises. Officer Rosario started with the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Officer Rosario observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. He also observed vertical gaze nystagmus. The second exercise was the Walk and Turn test. During the Walk and Turn test, Benita failed to touch heel-to-toe on each step, turned improperly, and took an incorrect number of steps. The final exercise was the One Leg Stand test. During the One Leg Stand test, Benita failed to raise her foot in the proper fashion and used her arms for balance. Based on her traffic infractions, the odor of burnt cannabis, and her inability to adequately perform the field sobriety exercises, Officer Rosario placed Benita under arrest for driving under the influence. A search of her vehicle incident to arrest yielded an open container of White Claw. Benita was transported to the Orange County DUI Testing Center for further processing, but she refused to submit breath samples after a 20-minute observation.
