Future Arrest: https://www.youtube.com/watch?v=BLecB4K3GHA Around 9:11 PM on December 5, 2022, Patrolman Kristopher Burke with the Barnegat Township Police Department responded to call involving a male and female who were arguing outside a white 2020 Toyota Corolla on Nautilus Drive. He arrived on scene and made contact with a 19-year-old female, who was identified as Nadia. Patrolman Calicchio made contact with the male, and the 2 parties were separated as the officers conducted their investigations. Nadia told Patrolman Burke that the 2 of them had driven to Burger King, after which they got into a verbal altercation due to his state of inebriation. As he was speaking with Nadia, he detected the odor of alcohol and observed other indicators of impairment. Based on his suspicion of impairment, he asked Nadia to perform field sobriety exercises. Patrolman Burke started with was the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, he observed 5/6 indicators of impairment. The second exercise was the Walk and Turn test. During the Walk and Turn test, Nadia failed to touch heel-to-toe on each step. The final exercise was the One Leg Stand test, and Nadia failed to raise her foot in the proper fashion and put her foot down before the test was complete. Based on the indicators of impairment, the odor of alcohol, and her inability to satisfactorily complete the field sobriety exercises, Patrolman Burke placed Nadia under arrest for driving under the influence. A search of the vehicle incident to arrest revealed the presence of 2 open bottles of vodka. After she was placed under arrest, her vehicle was impounded for a 12-hour hold according to John’s Law. Patrolman Burke transported Nadia to the Barnegat Township Police Department for further processing. At police headquarters, Nadia was read the Standard Statement for Motor Vehicle Operators, and she agreed to submit breath samples. Her Alcotest results indicated a BAC level of 0.20%, which was more than double the legal limit of 0.08% and 20 times the legal limit of 0.01% for drivers under 21. After the officers were finished with processing her, she was released to a sober adult pending her court appearance after he signed the Potential Liability Warning form on Nadia’s behalf. Patrolman Burke issued Nadia the following traffic citations: -Operating under the influence -Reckless driving -Open Container Court records indicate that Nadia was later arrested again for DWI in Middletown Township, New Jersey by the State Police on January 13, 2023. Following that arrest, Nadia was arrested for DWI yet again in Berkeley Township, New Jersey on March 27, 2023. Following these arrests, Nadia was charged with shoplifting (2C:20-11B(1)) on January 31, 2024 in Stafford Township, New Jersey. She was later charged with the allegations of criminal mischief (2C:17-3A(1)) and simple assault (2C:12-1A(1)) in Stafford Township, New Jersey on May 28, 2024. ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. Central Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
