On Friday December 3, 2021 at approximately 2136 hours, I, Officer Lafave, was on duty in full uniform displaying my badge of office, and in a marked NMSP patrol vehicle within the County of Bernalillo State of New Mexico. At this time, I was traveling south on Interstate 25 near Paseo Del Norte when I observed a vehicle, approaching from the rear, that appeared to be traveling at a high rate of speed. This vehicle passed me as it traveled in lane 1. I engaged my radars front antenna which displayed approximately 97 mph in a posted 65 mph zone. I caught up with this vehicle, a silver Nissan truck, activated my emergency equipment and conducted a traffic stop with this vehicle. I exited my patrol car and made contact with the male driver, later identified as Mark Garcia (Defendant), and asked Defendant to provide me his driver license, registration and insurance. Defendant provided me with his NM Driver's License 14-2-1.1 6254 and valid registration. While speaking with Defendant I smelled the strong odor of an alcoholic beverage from Defendant, male passenger and/or vehicle; Defendants eyes were bloodshot and watery and his speech was slurred. I asked Defendant to exit his vehicle where I explained the reason for the stop. While outside this vehicle I continued to smell the strong odor of an alcoholic beverage emitting from his breath as he spoke. I asked Defendant how much he had been drinking and he denied consuming any alcoholic beverages prior to this traffic stop but could not explain the reason for the alcoholic beverage odor emitting from his breath. Upon completion of all SFST's and based on my training and experience, I observed Defendant to display signs of impairment and determined Defendant was unable to continue to operate a motor vehicle safely. At 2152 hours Defendant was arrested for driving while under the influence of intoxicating liquor, placed in steel handcuffs that were fitted and locked for his safety. Defendant was read the New Mexico Implied Consent Advisory and verbally refused to be tested. Defendant was read the consequences for refusing and still refused. I checked the interior of his mouth which was clear of any foreign matter. He was then transported to the New Mexico State Police office in Albuquerque and after a 20-minute deprivation period (2152-2229 hours), Defendant failed to provide any breath sample into the IR8000 instrument SN 80-006652 resulting in the instrument to display, "No Sample Introduced." While getting Defendant ready for transport to PTC, he wanted to submit to a breath test. Defendant did not eat, drink or smoke during the entire deprivation period or following his refusal to submit to a breath test. At approximately 2255 hours, provided 2 valid samples that were at or above the per se limit. Actual results are .08/.08 with no secondary test was requested. A check of Defendant's driving history in NCIC returned valid with no prior DWI convictions making this a first offense.
