Future DWI Arrest: https://www.youtube.com/watch?v=-jEQfe-WIus Around 7:05 PM on December 20, 2023, Patrolmen Michael DeLuccia, Douglas Spinella, and Joseph Flynn with the Totowa Police Department responded to a report of a female shoplifter at the T.J. Maxx on 215 Route 46 West. They walked over to the loss prevention office and made contact with the alleged shoplifter, who was identified as Rebecca Sullivan. The loss prevention employees informed the officers that the woman had attempted to steal approximately $300 worth of items. Some of the other items in her bags were paid for. The loss prevention employees told the officers that Rebecca allegedly attempted to exit the store with unpaid items after spending about 2 hours inside the store. Based on their surveillance footage and the store’s decision to press charges, Patrolman DeLuccia placed Rebecca under arrest for shoplifting. After she was placed under arrest, she was escorted to the patrol car and they placed her purchased items inside her vehicle. Patrolman DeLuccia transported her to the Totowa Police Department for further processing. At police HQ, Rebecca was finger printed and photographed. She was charged with shoplifting under 2C:20-11B(1) and released pending her court appearance on January 4, 2024. Patrolman DeLuccia gave Rebecca a ride back to her car in the T.J. Maxx parking lot after she was released. Court records indicate that on May 2, 2024, Rebecca’s shoplifting charge was downgraded to an ordinance violation of fighting or disrupting public peace (284-5C) and she had to pay a total of $540 in fines. Rebecca was later cited for improper passing and traffic on marked lanes in Wayne, New Jersey on January 4, 2024. Following this traffic stop, Rebecca was arrested again for driving while intoxicated (DWI) in Denville Township, New Jersey on August 22, 2024. Court records indicate that Rebecca has previously been arrested on the following occasions: -Possession (2C:35-10A(1)) on July 18, 2017 -Possession (2C:36-6A) on April 29, 2017 -Possession (2C:36-2) on March 13, 2017 -Possession (2C:35-10A(1)) on January 6, 2017 -Possession (2C:35-10C) on September 16, 2016 -Driving while intoxicated (DWI) in Mahwah, NJ on October 5, 2013 -Possession (2C:35-10C) on February 14, 2012 ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). This is similar to other law enforcement channels on YouTube. All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq. (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
