Around 10:42 PM on June 3, 2025, Patrolmen Nathaniel Barnor and Erik Macario with the Hopatcong Police Department responded to a report of motor vehicle accident on Helen Road. They arrived on scene and noticed that a red 2007 Volvo C70 had reversed onto a rock wall and into a ditch. The homeowner was outside at the time, while the officers made contact with the driver of the Volvo. The driver was eventually identified as Jessica Hoynowski. Jessica told the officer that she was coming from a pub in Netcong. As he was speaking with Jessica and Ashley, the officers detected the odor of alcohol. She admitted to consuming 3 drinks earlier that evening. Based on their suspicion of impairment, Jessica was asked to perform field sobriety exercises. Patrolman Macario started with the Horizontal Gaze Nystagmus (HGN) test, and he observed 6/6 indicators of impairment. The second exercise was the Walk and Turn test. During the Walk and Turn test, Jessica failed to touch heel-to-toe on each step, turned improperly, and failed to keep her arms at her sides. The final exercise was the One Leg Stand test. During the One Leg Stand test, Jessica failed to raise her foot in the proper fashion. Based on the motor vehicle crash, her admission to consuming alcohol earlier that evening, the odor of alcohol, and her inability to satisfactorily complete the field sobriety exercises, Jessica was placed under arrest for DWI. As she was being placed under arrest, Jessica assaulted the officers. Her vehicle was impounded by Riche’s Towing for a 12-hour hold according to John’s Law. Patrolman Barnor transported Jessica to the Hopatcong Police Department for further processing. At the station, the Standard Statement for Motor Vehicle Operators was read to her, but she refused to submit breath samples. After they photographed and fingerprinted her, Jessica she was unable to find anyone to take responsibility for her. As a result, she was placed inside cell 1 until she could be released on her own recognizance by day shift. Patrolman Barnor issued Jessica the following traffic tickets: -Operating under the influence (39:4-50) -Refusal to submit to chemical test (39:4-50.4A) -Reckless driving (39:4-96) -Careless driving: operate motor vehicle causing property damage (39:4-97A) -Improper backing or turning (39:4-127) -Failure to report accident (39:4-130) -Failure to conform to motor vehicle inspection law (39:8-9) She was also criminally charged with aggravated assault on a law enforcement officer (2C:12-1B(5)(A)), resisting arrest (2C:29-2A(1)), and disorderly conduct (2C:33-2A(2)). Court records indicate that on January 12, 2026, Jessica pleaded guilty to operating under the influence. As a result of her conviction, Jessica had to perform 30 days of community service, spend 48 hours at an intoxicated driver resource center, use an ignition interlock device for 2 years, and pay a total of $890 in fines. In addition, she sentenced to 2 days in jail. Her 3 criminal charges are still pending in court. Jessica had previously been arrested for DWI in Maplewood, NJ on December 9, 2023. Prior to that, she had also been assaulted on charges of simple assault (2C:12-1A(1)) in South Orange, NJ on July 25, 2022. ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2001, c. 404). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
