FWC Officers were on water-based patrol in the IntraCoastal waterway (ICW) south of Blue Heron Bridge located in Palm Beach County. They observed a vessel heading north in the (ICW) displaying fishing rods. They initiated a vessel stop to conduct a fisheries inspection. Upon contact with the vessel operator, later identified as [REDACTED], Officer Morgan noticed that the individual had slightly slurred words when speaking. [REDACTED] also had glassy eyes with droopy eyelids and exhibited unstable movements, needing to brace while standing. The odor of an unknown alcoholic beverage was detected coming from the vessel. Officer Morgan explained the purpose of the inspection, to which [REDACTED] stated they had not caught anything that day. Officer Morgan then conducted a boater safety inspection for the required equipment. As [REDACTED] moved around the vessel, Officer Morgan detected the smell of alcohol coming from the individual's person. Officer Morgan asked [REDACTED] if they would perform Seated Standardized Field Sobriety Tasks (SFSTs) to determine impairment, to which [REDACTED] consented. [REDACTED] boarded Officer Morgan's vessel to begin the tasks. Officer Morgan administered the Horizontal Gaze Nystagmus (HGN) and attempted to administer Finger to Nose, Palm Pat, and Hand Coordination tasks in that standardized order. During the HGN task, [REDACTED] showed clues in both eyes, including lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and onset of nystagmus prior to 45 degrees. [REDACTED] also showed vertical nystagmus, totaling 6 clues for impairment, indicating potential intoxication. The next task attempted was the Finger to Nose task. While reading the instructions, [REDACTED] inquired about ceasing the task, to which Officer Morgan explained the implications of such actions. Despite this, [REDACTED] refused to continue with SFSTs. Considering the totality of circumstances, including [REDACTED]'s glassy eyes, droopy eyelids, the smell of alcohol on their breath, coordination impairment, and speech difficulties, [REDACTED] was arrested for boating under the influence --- Operating a vessel with normal faculties impaired. [REDACTED] was placed under arrest at 1930 hours on 07/30/23. Disposition of Vessel: The vessel was released to a passenger, [REDACTED], on the vessel as per [REDACTED]'s request. After being placed under arrest, [REDACTED] was transported to Rybovich Marina to be transferred from the patrol vessel to Officer Morgan's patrol truck. During this, [REDACTED] expressed regret, acknowledging previous DUI incidents and stating a need to avoid such situations. [REDACTED] was then transported to the Breath Alcohol Test (BAT) facility located at Palm Beach County main jail on Gun Club Road, arriving at 2016 hours. [REDACTED] was read implied consent and requested to provide a breath sample for alcohol content determination, which [REDACTED] refused. After being read the refusal section on implied consent and acknowledging, [REDACTED] still refused. [REDACTED] declined to answer questions post-Miranda being read. [REDACTED] was booked into the Palm Beach County Main Jail at 2141 hours on 07/30/23.
