#news #police #arrest #cops Offenses: Failure to Maintain Lane/Improper Driving on Road DUI - Alcohol - Less Safe Report: On October 20, 2021, Officer noticed the Jeep in front of me fail to maintain its lane. I had just pulled in behind the Jeep so I figured they were just checking their mirror and got nervous seeing it was a police car. I continued to follow the Jeep to make sure that its driving behavior would return to normal. As we rounded a curve, the Jeep began to travel into the lane of oncoming traffic. I watched the driver's side tires cross the double yellow line, then return to the correct lane. The Jeep then travelled across the lane and the passenger tires struck the fog line. A vehicle was approaching us in oncoming traffic and the Jeep started to drift back towards their lane. Their tires struck the double yellow line again and almost caused a head on collision with oncoming traffic. I turned on my blue lights and conducted a traffic stop. The vehicle was slow to pull over but eventually did. I approached the vehicle and addressed the driver. The driver had slurred speech but explained to me that she left the house to go get food for her and her roommate. She showed me the food. I asked her for her license and she provided it to me. She identified herself as Michelle King. She stated that she just moved from Texas. I asked her If she was willing to do some tests to determine if she was safe to drive. She stated that she would like to just go home since she lived nearby. I explained to her that if she passes my tests and is safe to drive, that I will allow her to drive home. She got out of the vehicle. When she got out, should struggled to gain her balance. She took multiple steps in place in an attempt to regain her balance. I asked her to walk across the road to a flat paved driveway. While walking across the road, she was not walking in a straight line and she kept losing her balance and having to catch herself with a side step and raising her arms. I explained the horizontal gaze nystagmus (HGN) test and told her not to move her head while looking at the stimulus (my finger). AS she listened to instructions, she was swaying back and forth. I began the test. When looking for lack of smooth pursuit, I detected nystagmus in both eyes. While looking for distinct and sustained nystagmus at maximum deviation, I detected nystagmus in both eyes. When looking for the onset of nystagmus prior to 45 degrees, I detected nystagmus in both eyes. I then tested vertically. At maximum deviation, I detected nystagmus in both eyes. This gave me a total of 6 clues. While doing this test, I was close enough to King to detect the odor of alcohol on her breath. She asked to do the next test. The walk and turn test provided me with 5 clues. I then positioned King for the one leg stand test. This test gave me a total of 3 clues. I asked King if she was willing to blow into an alcosensor to confirm that alcohol was on her breath and she told me no. While on the way to the jail, King kept asking me if there was any way I could just take her home. I told her no. At one point during the ride, she asked if she could bribe me to not arrest her and to just take her home. I explained to her that she needed to stop saying stuff like that or she would end up with an additional charge. I transported King to the jail without incident.
