Around 3:04 AM on May 20, 2020, Officer Nicholas Grasso and Officer John Doesburgh with the Bridgewater Police Department responded to a call of a possibly impaired driver near the Target at 200 Promenade Boulevard. A Somerset County dispatcher who was heading home from work had advised police of a driver of a white Subaru that had struck the curb in the vicinity of Finderne Avenue, while continuing to drive erratically. As Officer Grasso arrived on scene, he observed a woman attempting to change a flat tire on a 2012 Subaru Impreza. He informed dispatch and proceeded to make contact with the driver, who was identified as 27-year-old Danielle. As Officer Grasso began to interact with Danielle, he detected the odor of alcohol and noticed other signs of impairment. Danielle was asked where she had been coming from, and she claimed to be coming from a concert in Bethlehem, Pennsylvania. She also admitted to consuming alcohol several hours earlier, but denied being under the influence at the moment. Based on their suspicion of impairment, Danielle was offered an opportunity to participate in field sobriety exercises. Officer Grasso started with the Horizontal Gaze Nystagmus (HGN) test, and he observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. The second exercise was the Walk and Turn Test. During the Walk and Turn test, Danielle did not touch heel-to-toe on each step, turned improperly, and failed to count in the proper sequence. The final exercise was the One Leg Stand test, and Danielle failed to raise her foot in the proper fashion or count aloud as instructed. Officer Doesburgh administered the HGN test one more time, and he also observed 4/6 indicators of impairment. Based on the witness account, the odor of alcohol, and her inability to complete the field sobriety exercises, Danielle was placed under arrest. After she was placed under arrest, her vehicle was impounded for a 12-hour hold according to John’s Law. Officer Grasso transported Danielle to the Bridgewater Police Department for further processing. At the station, they read her the Standard Statement for Motor Vehicle Operators and she agreed to submit breath samples. Her Alcotest results indicated a BAC of 0.16%, which is more than double the legal limit of 0.08%. She later invoked her Miranda rights and refused to answer questions. After they were finished processing Danielle, she was released to a sober adult after she signed the Potential Liability Warning on her behalf. Officer Grasso issued Danielle a citation for operating under the influence. Court records indicate that on October 17, 2023, Danielle pleaded not guilty to operating under the influence, and the citation was DISMISSED in court. --------------------------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq. (P.L. 2001, c. 404). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
