I observed a silver Pontiac passenger car drive over the center line twice while it was traveling westbound on Saint Joe Road. I then activated my lights an attempt to make a traffic stop on the vehicle. The vehicle then turned westbound onto State Highway 326 and began to accelerate. I then turned my siren on and initiated pursuit with the vehicle at that time. While traveling on State Highway 326 the suspect, later identified as Kelly Duncan, passed vehicles and was traveling at speeds up to 112 miles per hour. Duncan then turns Northbound onto State Highway 124 from State Highway 326. While traveling on State Highway 124, Duncan passed approximately 7 vehicles and was traveling at speeds up to 107 miles per hour. At approximately the 10000 block of State Highway 124, Arkansas State Police Corporal Stewart Condley got in front of Duncan and attempted to slow his speed and stop the vehicle. Corporal Condley was able to slow Duncan’s speed down to approximately 45 miles per hour before Duncan then made an abrupt left turn onto State Highway 164 East headed westbound. While traveling westbound on State Highway 164 East, Duncan past approximately 3 vehicles and was traveling at speeds up to 107 miles per hour. After several miles on State Highway 164 East, Duncan then took a right turn onto Landers Loop traveling northbound. While on Landers Loop, Duncan passed approximately one vehicle and was traveling at speeds up to 102 miles per hour. Duncan then turned right onto Clark Road and was traveling at speeds up to 53 miles per hour before running the stop sign taking a right-hand turn onto State Highway 27. While traveling on State Highway 27, Duncan passed approximately 12 vehicles and was traveling at speeds up to 106 miles per hour. Duncan then took a left-hand turn onto State Highway 164 North. While traveling on State Highway 164 North, Duncan passed approximately two vehicles and was traveling at speeds up to 101 miles per hour. Duncan continued straight onto Granny Gap 1 Road from State Highway 164 North. While traveling on Granny Gap 1 Road, Duncan traveled at speeds up to 95 miles per hour before taking a right-hand turn into the driveway of 2506 Granny Gap 1 Road. While Duncan was attempting to make the right-hand turn, he lost control of his vehicle and hit the side of a silver passenger car that was occupied by a young juvenile in a car seat. I continued to pursue Duncan down several trails that appeared to me to be ATV trails. While traveling down these trails Duncan lost his front bumper. I continued to travel down the trails when I observed Duncan exit the driver's side of the vehicle and flee on foot. I then told dispatch I was in a foot pursuit and began to give verbal commands to Duncan to stop running to which I could hear Duncan say no. While Duncan continued to run, i observed him fall down an approximant 15-foot vertical embankment into a creek bed. I then attempted to make my way down the embankment. Once down in the embankment, t, I observed a silver long-barreled revolver in Duncan’s left hand and could hear him saying “I’ve got a gun”. I then pulled my service weapon out and gave several verbal commands to Duncan to drop the weapon. Duncan said several times he wasn’t going to go back to jail. I continued to give verbal commands to Duncan which he ignored. After several minutes of negotiation, I was able to talk Duncan into throwing the gun onto the ground and stepping away from it. Duncan then surrendered. While searching Duncan before placing him in the back of my vehicle, I located in his front right pocket approximately 11.11 grams of a crystal-like substance I suspect, through my training and experience, to be methamphetamine in two separate bags. I also placed the firearm that Duncan was in possession of in a bag to be placed into evidence. Duncan was then placed into the back of my patrol vehicle, and I transported him to the Pope County Detention Center where I released him to the jail staff. I then placed a felony hold on Kelly Duncan for Fleeing (5-54-125)(Felony), Simultaneous possession of drugs and firearms (5-74-106)(Felony), Possession of a firearm by certain person (5-73-103)(Felony), Possession of a controlled substance (5-64-419)(b)(1)(c)(Felony), Fleeing (5-54-125) (misd), Left of center (27-51-301)(misd), Driving with license suspended (27-16-303)(misd), Fictitious vehicle license (27-14-306)(misd), improper passing (27-51-307)(misd), no proof of insurance (27-22-104)(misd), Stop sign violation 27-51-601)(misd), no seat belt (27-37-702)(misd), careless or prohibited driving (27-51-104)(misd), leaving the scene of an accident (27-53-102)(misd), Endangering the welfare of a minor (5-27-206)(misd), and expired tags (27-14-601) (misd). While Corporal Woods was conducting an inventory of the vehicle, he located three glass smoking pipes with suspected methamphetamine residue inside all three of them in the front console under the radio.
