My contention is that, no matter how cruddy we may think a person is (like cops and prosecutors), people (whoever they may be) are free to exist and move around in ALL public spaces. There is an argument being made that Clarke Cooke House purchased a permit (permission slip from the government) to BLOCK that portion of public access with their tables and chairs. One auditor says, "While the sidewalk itself remains public property, when a restaurant like Clarke Cooke House in Newport, RI obtains a permit for outdoor dining, that permit grants them the right to occupy and control that specific area for their business operations during work hours." Are we now saying that the government has the power to legitimately "grant rights?" Aren't rights unalienable or are we breaking from that idea altogether? While the city and a massive amount of people may accept this as legitimate, is it? If you agree that a business owner can buy permission from the government for the RIGHT to block a public sidewalk, then the sky's the limit. This essentially means that no member of the public has the right to move freely in certain areas of a public space as long as business owners can BUY YOUR RIGHTS AWAY. Essentially the business owner is telling the government, "here's a thousand bucks (or whatever the amount is), I want exclusive RIGHTS to this area outside of my business, and I want your armed men to forcibly remove anyone who doesn't cooperate with my demands to leave." And the government takes their money and basically says, "We have now become your trusty enforcers." Think about it: If they can regulate your right to EXIST in a certain place and if they can GRANT special rights to others for a sum of cash, this would mean that a business owner can LEGALLY infringe on ALL of your most basic rights (speech, religion, assembly) simply because they've expanded their private business to include a portion of the public sidewalk. What's worse, is that, along with that purchase (which infringes on the basic freedom of movement), people are saying that police VIOLENCE can legitimately be used against anyone who chooses to exercise their freedoms in that particular zone. So, while this may be "legal," it's not only immoral, but it's a slippery slop (down the tyrannical cliff), that could expand to extinguish even more freedoms in more areas, including outside of banks, pot shops and wherever else businesses might try to buy police protection. This is similar to what Winter Garden Fla tried to do to Liberty Hangout. Not exactly the same, because it was a city sponsored event...but there are many similarities. The bottom line is that people believe freedoms can be taken when government permission is purchased.
