Around 2:10 AM on April 7, 2023, Officer Christopher Serpico of the Old Bridge Police Department was on patrol on Route 34, and he observed 2017 Honda Accord with inoperable brake lights driving southbound. As he followed the vehicle, the vehicle was moving at a slow rate of speed, and continued to alternate between going at the speed limit and driving slowly. Officer Serpico proceeded to initiate a traffic stop based on these driving patterns. The driver of the vehicle, 25-year-old Kayla Marie Cacoilo, told the officer that she and her passenger were heading home from their shifts at the Red Zebra Gentleman’s Club, and that they worked as bartenders there. Upon further questioning, the driver admitted to consuming alcohol in the hours prior, but insisted that she was not too impaired to drive. After he asked for her driver's license, Officer Serpico was informed by Kayla that her license was suspended, and he also noticed that her eyes were watery while her speech was slurred. However, Kayla was able to provide a New Jersey ID, and he returned to his patrol car to verify her identity. Upon running the identification card, it was revealed that Kayla had 3 outstanding arrest warrants as follows: $350 out of Newark for failure to appear, $250 out of Newark for failure to appear, and $550 out of Elizabeth for failure to appear As he returned to the vehicle, he instructed the driver to move the vehicle into the parking lot of a nearby CVS on 27 Morristown Road for safety reasons, and he escorted the vehicle into the parking lot. When he was talking with the driver on the driver’s side, he detected the odor of an alcoholic beverage, and he asked both the driver and passenger how much alcohol they had consumed earlier. Kayla initially claimed that she had only consumed 2 drinks. Around this time, Officer Andrew Annuzzi arrived on scene to assist. Based on her indicators of impairment, Officer Serpico offered Kayla the opportunity to perform field sobriety exercises. The first exercise involved the Horizontal Gaze Nystagmus test, which was administered by Officer Annuzzi. Officer Annuzzi observed 6/6 indicators of impairment during this test. The second exercise was the Walk and Turn test, and it was administered by Officer Serpico. During this exercise, Kayla walked an incorrect number of steps and failed to turn properly. The third exercise was the One Leg Stand test, and Kayla did not raise her foot in the proper fashion while placing her leg down after only 15 seconds in order to regain her balance. Based on her admission to coming from a bar, her erratic driving patterns, and her inability to adequately complete the field sobriety exercises, Officer Serpico placed Kayla under arrest for driving under the influence. After she was placed under arrest, her vehicle was searched and the registered owner of the vehicle came to the scene to retrieve it. The registered owner completed the forms under John’s Law before she could drive the vehicle home. She was also cited under R.S. 39:3-40.1C for allowing someone with a suspended license to operate her vehicle. Kayla was transported by Officer Serpico to the Old Bridge Police Headquarters. An officer read her the Standard Statement for Motor Vehicle Operators form, and Kayla subsequently agreed to submit breath samples for testing. Officer Annuzzi administered the breathalyzer, and Kayla’s Alcotest results indicated a BAC of 0.16%, which is double the legal limit of 0.08%. After Kayla was processed, the officers checked with Newark and Elizabeth regarding her 3 outstanding arrest warrants. Those departments declined to retrieve her, so Kayla was given new court dates instead. After all the paperwork was completed, Kayla was given 2 Bail Recognizance (ROR) forms for the outstanding warrants and released to a sober person after she signed the Potential Liability Warning form on Kayla’s behalf. Officer Serpico issued Kayla the following summonses: Operating under the influence, reckless driving, driving while suspended, unlicensed driver, obstructed windshield, and maintenance of lamps. ----------------------------------------------------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information).
